What is the News?<\/b><\/h5>\n

The Supreme Court has agreed to hear a petition challenging the changes made to the right to freedom of speech and expression by the first amendment to the Constitution.<\/span><\/p>\n

What is the basis of the petitioner’s arguments?<\/b><\/h5>\n

Section 3(1) of the Constitution (First Amendment) Act,1951 inserted two clauses \u2013 \u201cin the interest of public order\u201d and \u201cin relation to incitement to an offense\u201d \u2013 to Article 19(2) that deals with restrictions on freedom of speech. The expression \u201ctends to overthrow the state\u201d was also removed through this amendment.<\/span><\/p>\n

Section 3(2) of the First Amendment effected validation of certain laws even if they took away or abridged the right to freedom of speech and expression.<\/span><\/p>\n

Why have the petitioners challenged these amendments?<\/b><\/h5>\n

Firstly, <\/b>these two<\/span> insertions protected the following sections of the Indian Penal Code from the vice of unconstitutionality:<\/span><\/p>\n

1) Sections 124A<\/strong> (sedition)\u00a0<\/span><\/p>\n

2) Section 153A<\/strong> (promoting enmity between different groups on grounds of religion, race, place of birth, residence, language, etc)\u00a0<\/span><\/p>\n

3) Section 295A<\/strong> (deliberate and malicious acts, intended to outrage religious feelings of any class by insulting its religion or religious beliefs) and\u00a0<\/span><\/p>\n

4) Section 505<\/strong> (statements conducing to public mischief)\u00a0<\/span><\/p>\n

Secondly,<\/b> the <\/span>amendment neglects national security by dropping the expression \u2018tends to overthrow the State\u2019 which raises grave concern in the context of the dangers posed to the concept of the secular democratic republic by radicalism, terrorism and religious fundamentalism.<\/span><\/p>\n

Hence, on this basis, the petitioners <\/span>urged the court to declare Sections 3 (1)(a) and 3 (2) of the First Amendment \u201cbeyond the amending power of Parliament\u201d and void since the \u201csame damage the basic or essential features of the Constitution and destroy its basic structure\u201d.<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"
