The expression \u201ctends to overthrow the state\u201d was also removed through this amendment.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Section 3(2) of the First Amendment effected validation of certain laws even if they took away or abridged the right to freedom of speech and expression.<\/span><\/p>\n<h5><b>Why have the petitioners challenged these amendments?<\/b><\/h5>\n<p><b>Firstly, <\/b><span style=\"font-weight: 400;\">these two<\/span><span style=\"font-weight: 400;\"> insertions protected the following sections of the Indian Penal Code from the vice of unconstitutionality:<\/span><\/p>\n<p><span style=\"font-weight: 400;\">1) <strong>Sections 124A<\/strong> (sedition)\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">2) <strong>Section 153A<\/strong> (promoting enmity between different groups on grounds of religion, race, place of birth, residence, language, etc)\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">3) <strong>Section 295A<\/strong> (deliberate and malicious acts, intended to outrage religious feelings of any class by insulting its religion or religious beliefs) and\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">4) <strong>Section 505<\/strong> (statements conducing to public mischief)\u00a0<\/span><\/p>\n<p><b>Secondly,<\/b><span style=\"font-weight: 400;\"> the <\/span><span style=\"font-weight: 400;\">amendment neglects national security by dropping the expression \u2018tends to overthrow the State\u2019 which raises grave concern in the context of the dangers posed to the concept of the secular democratic republic by radicalism, terrorism and religious fundamentalism.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Hence, on this basis, the petitioners <\/span><span style=\"font-weight: 400;\">urged the court to declare Sections 3 (1)(a) and 3 (2) of the First Amendment \u201cbeyond the amending power of Parliament\u201d and void since the \u201csame damage the basic or essential features of the Constitution and destroy its basic structure\u201d.<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Source: The post is based on the article \u201cSC agrees to hear plea challenging first amendment to Constitution\u201d published in Indian Express on 1st November 2022.
