{"id":217734,"date":"2022-12-09T19:57:56","date_gmt":"2022-12-09T14:27:56","guid":{"rendered":"https:\/\/blog.forumias.com\/?p=217734"},"modified":"2022-12-09T19:57:56","modified_gmt":"2022-12-09T14:27:56","slug":"process-to-appoint-ad-hoc-judges-must-be-less-cumbersome-supreme-court","status":"publish","type":"post","link":"https:\/\/forumias.com\/blog\/process-to-appoint-ad-hoc-judges-must-be-less-cumbersome-supreme-court\/","title":{"rendered":"Process to appoint ad hoc judges must be less cumbersome: Supreme Court"},"content":{"rendered":"\n<p><b>Source: <\/b><span style=\"font-weight: 400;\">The post is based on the article<\/span><b> \u201cProcess to appoint ad hoc judges must be less cumbersome: Supreme Court\u201d <\/b><span style=\"font-weight: 400;\">published in<\/span><b> The Hindu <\/b>on<b> 9th December 2022<\/b><\/p>\n<h5><b>What is the News?<\/b><\/h5>\n<p><span style=\"font-weight: 400;\">The Supreme Court has said that the process suggested by the Centre for the appointment of ad-hoc judges in high courts is \u201cvery cumbersome\u201d and suggested a simpler procedure should be adopted so the real objective of their appointment doesn\u2019t get defeated.<\/span><\/p>\n<h5><b>Background<\/b><\/h5>\n<p><span style=\"font-weight: 400;\">In 2021, the Supreme Court had laid down certain guidelines for making appointment of ad hoc judges on a petition filed by NGO Lok Prahari.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The judgment noticed that Article 224A has largely been a \u201cdormant provision\u201d with only three recorded instances of its invocation in 1972 (Madhya Pradesh high court), 1982 (Madras high court) and 2007 (Allahabad high court).\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u2013 <\/span><b>Note:<\/b><span style=\"font-weight: 400;\"> According to Article 224A, the chief justice of a high court can request a retired judge of any high court to become a judge of that particular high court. Such an appointment would come into effect with the approval of the President of India.\u00a0<\/span><\/p>\n<h5><b>What are the guidelines laid down by the Supreme Court for making appointments of ad hoc judges?<\/b><\/h5>\n<p><a href=\"https:\/\/forumias.com\/blog\/sc-guidelines-for-appointment-of-ad-hoc-judges-in-hcs\/\"><b>Click Here to read<\/b><\/a><\/p>\n<p><span style=\"font-weight: 400;\">\u200b\u200bThis judgment required the Centre to prepare a Memorandum of Procedure(MoP) for this.<\/span><\/p>\n<h5><b>What is the MoP prepared by the Centre?<\/b><\/h5>\n<p><span style=\"font-weight: 400;\">The MoP prepared by the Centre for appointing ad hoc judges to High Courts has nearly 20 service conditions which included a six-monthly review of their performance, a report to be drawn out on the judgments delivered and a minimum three years\u2019 service as district judicial officer among other conditions.<\/span><\/p>\n<h5><b>What was the Supreme Court\u2019s view on this MoP?<\/b><\/h5>\n<p><span style=\"font-weight: 400;\">The Supreme Court suggested the Centre to prepare a simpler MoP as these judges <\/span><span style=\"font-weight: 400;\">are not being selected for the first time.
