What was the opinion of the constitutional assembly on Tribal rights?<\/h5>\n

Ambedkar opposed any reservation for tribal persons in legislatures because he felt that \u201cthey had not developed any political sense to make the best use of their political opportunities.\u201d<\/p>\n

Nehru, on the other hand, disagreed with the thoughts of Ambedkar and said that \u201cEvery care should be taken in protecting the tribal areas, those unfortunate brethren of ours who are backward through no fault of theirs.\u201d<\/p>\n\n\n\n

How\u00a0tribal rights are ignored even today?<\/h5>\n

Firstly<\/strong>, there are many pre-Independence laws that exhibit prejudice towards tribals and continue to remain in force<\/strong>. For example, The Sonthal Parganas Act of 1855 was still remains in force. The Act was enacted as a response to the Santhal uprising against the East India Company.<\/p>\n

The Act excludes certain districts in the erstwhile Bengal Presidency from the application of the \u2018general Regulations and Acts of Government\u2019. The Act is based on a simple premise \u2013 Santhals are too \u2018uncivilised\u2019 a people to be governed by the legal system.<\/p>\n

Secondly<\/strong>, protectionism and prejudice continue with post-independence laws<\/strong> also. For example, the Habitual Offenders\u2019 Model Bill of 1952 replaced the Criminal Tribes Act, 1871 and served as the basis for state-level Habitual Offenders\u2019 Acts.<\/p>\n

With the repeal of this Act, the \u2018criminal tribes\u2019 came to be \u2018de-notified\u2019. In almost every state where Habitual Offenders\u2019 Acts are in force, individuals belonging to the de-notified tribes have been disproportionately targeted.<\/p>\n

Thirdly<\/strong>, the old colonial idea of primitivism continues<\/strong> under the impression of protecting cultural autonomy. The Fifth and Sixth Schedules of the Constitution lay out a set of special provisions for tribal areas.<\/p>\n

Under this, governors are empowered to prevent<\/strong> or modify the application of both central and state laws to these scheduled areas.\u00a0These areas were previously \u2018typically and really backward tracts\u2019 under the Government of India Act, 1919 and \u2018partially and wholly excluded areas<\/strong>\u2019 under the Government of India Act, 1935.<\/p>\n\n\n\n
