For example, The Sonthal Parganas Act of 1855 was still remains in force. The Act was enacted as a response to the Santhal uprising against the East India Company.<\/p>\n<p>The Act excludes certain districts in the erstwhile Bengal Presidency from the application of the \u2018general Regulations and Acts of Government\u2019. The Act is based on a simple premise \u2013 Santhals are too \u2018uncivilised\u2019 a people to be governed by the legal system.<\/p>\n<p><strong>Secondly<\/strong>, <strong>protectionism and prejudice continue with post-independence laws<\/strong> also. For example, the Habitual Offenders\u2019 Model Bill of 1952 replaced the Criminal Tribes Act, 1871 and served as the basis for state-level Habitual Offenders\u2019 Acts.<\/p>\n<p>With the repeal of this Act, the \u2018criminal tribes\u2019 came to be \u2018de-notified\u2019. In almost every state where Habitual Offenders\u2019 Acts are in force, individuals belonging to the de-notified tribes have been disproportionately targeted.<\/p>\n<p><strong>Thirdly<\/strong>, the <strong>old colonial idea of primitivism continues<\/strong> under the impression of protecting cultural autonomy. The Fifth and Sixth Schedules of the Constitution lay out a set of special provisions for tribal areas.<\/p>\n<p>Under this, <strong>governors are empowered to prevent<\/strong> or modify the application of both central and state laws to these scheduled areas.\u00a0These areas were previously \u2018typically and really backward tracts\u2019 under the Government of India Act, 1919 and \u2018<strong>partially and wholly excluded areas<\/strong>\u2019 under the Government of India Act, 1935.<\/p>\n<table style=\"border-collapse: collapse; width: 100%;\">\n<tbody>\n<tr>\n<td style=\"width: 100%;\"><strong>Read more: <a href=\"https:\/\/forumias.com\/blog\/dilemma-of-tribal-rights-and-forest-conservation\/\">Dilemma of tribal rights and forest conservation<\/a><\/strong><\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<h5>How India&#8217;s approach to tribal rights can be changed?<\/h5>\n<p>The duty of the government is to <strong>address the social and educational backwardness<\/strong> affecting members of the tribal population.
