{"id":224879,"date":"2023-02-03T19:29:48","date_gmt":"2023-02-03T13:59:48","guid":{"rendered":"https:\/\/blog.forumias.com\/?p=224879"},"modified":"2023-02-22T11:39:01","modified_gmt":"2023-02-22T06:09:01","slug":"no-bar-on-contesting-two-seats-in-one-poll","status":"publish","type":"post","link":"https:\/\/forumias.com\/blog\/no-bar-on-contesting-two-seats-in-one-poll\/","title":{"rendered":"No bar on contesting two seats in one poll"},"content":{"rendered":"\n<p><b>Source: <\/b><span style=\"font-weight: 400;\">The post is based on <strong>the<\/strong> article<\/span><b> \u201cNo bar on contesting two seats in one poll<\/b><b>\u201d <\/b><span style=\"font-weight: 400;\">published in <\/span><b>The Hindu<\/b> on<b> 3rd February 2023<\/b><\/p>\n<h2><b>What is the News?<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">The Supreme Court has refused to set aside a provision in the election law which allows candidates to contest polls from two constituencies simultaneously.<\/span><\/p>\n<h2><b>What was the case about?<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">A petition was filed in the Supreme Court <\/span><span style=\"font-weight: 400;\">to declare Section 33(7) of the Representation of People Act invalid and ultra vires.<\/span><\/p>\n<p><b>Note: <\/b><span style=\"font-weight: 400;\">As per Section 33(7) of the RPA (Representation of the People Act), 1951, one candidate can contest from a maximum of two constituencies.<\/span><\/p>\n<h2><b>What is the government\u2019s stand on one candidate contesting from two seats?<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">The Union Government <\/span><span style=\"font-weight: 400;\">had argued that law cannot curtail the right of a candidate to contest elections and curtail the polity\u2019s choice of candidates.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The government had further told the Supreme Court that one-candidate-one-constituency restriction would require a legislative amendment.<\/span><\/p>\n<h2><b>What are the concerns associated with one candidate contesting from two seats?<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">When a person contests election from two constituencies and wins from both, then he\/she vacates the seat in one of the two constituencies.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The consequence is that a by-election would be required from one constituency involving avoidable expenditure on the conduct of that by-election.<\/span><\/p>\n<h2><b>What are the suggestions of the Election commission on one candidate contesting from two seats?<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Election Commission has suggested:<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The law should be amended to provide that a person cannot contest from more than one constituency at a time or\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The candidate should deposit an amount of \u20b95 lakh for contesting in two constituencies in an Assembly election or \u20b910 lakh in a general election.
