He was charged with Unlawful Activities (Prevention) Act <strong>(UAPA)<\/strong> and the Prevention of Money Laundering Act <strong>(PMLA)<\/strong>.<\/p>\n<p>This issue highlights the concerns of prisoners who are kept in jails for a long period.<\/p>\n<h2><strong>What are the concerns with the Indian laws and prisoners?<\/strong><\/h2>\n<p>SC in recent cases has recalled <strong>Justice Krishna Iyer\u2019s 1977 guidance<\/strong> in which he called for \u201c<strong>Bail not jail<\/strong>\u201d.<\/p>\n<p>However, many laws like the <strong>UAPA<\/strong> discourage bail and even the judiciary goes along with the pre-trial arrest and long hearing, instead of taking the responsibility of preserving the liberty of all citizens.<\/p>\n<p>Furthermore, <strong>conviction rates are low in IPC crimes<\/strong>, e.g., 42.4% for murder, 28.6% for rape, and 21.9% for riots. It is the <strong>undertrial prisoners which constitute 80% of the country\u2019s prisoners<\/strong>, crowding the jails.<\/p>\n<p><strong>Most victims do not have the legal, financial and emotional resources<\/strong> to fight for themselves and lead out of jail.<\/p>\n<p>However, if courts take action properly, then even these resources wouldn\u2019t be needed by the undertrials.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Source: The post is based on an article\u00a0\u201cSystem Bails Out \u2013 Kappan finally free on bail but many aren\u2019t, in contravention of juridical principles\u201d published in The Times of India on\u00a03rd February 2023.
