The Election Commission of India fixed a date for a by-election to that constituency. <\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559740&quot;:276}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">However, the Kerala High Court stayed his conviction and sentence. The High Court said that the consequence of not suspending the conviction is drastic not just for the particular person but also for the nation. T<\/span><span data-contrast=\"auto\">he MP then challenged the ECI\u2019s announcement in the SC of India. <\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559740&quot;:276}\">\u00a0<\/span><\/p>\n<h2><b><span data-contrast=\"auto\">What is the question before SC?<\/span><\/b><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559740&quot;:276}\">\u00a0<\/span><\/h2>\n<p><span data-contrast=\"auto\">It is related to whether the person automatically will resume his<\/span><b><span data-contrast=\"auto\"> membership of the Lok Sabha<\/span><\/b><span data-contrast=\"auto\">.\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559740&quot;:276}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">The answer lies in deciding whether the cancellation of disqualification takes effect when the High Court suspended the conviction or from the <\/span><b><span data-contrast=\"auto\">date of conviction and disqualification.<\/span><\/b><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559740&quot;:276}\">\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559740&quot;:276}\">\u00a0<\/span><\/p>\n<h2><b><span data-contrast=\"auto\">What are constitutional and legal provisions regarding the disqualification of a sitting member of Parliament?<\/span><\/b><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559740&quot;:276}\">\u00a0<\/span><\/h2>\n<p><b><span data-contrast=\"auto\">Article 102 of the Constitution<\/span><\/b><span data-contrast=\"auto\"> contains provisions for disqualification. It specifies that a<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559740&quot;:276}\">\u00a0<\/span><span data-contrast=\"auto\">person shall be disqualified from contesting elections and being a Member of Parliament<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559740&quot;:276}\">\u00a0<\/span><span data-contrast=\"auto\">under certain conditions.\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559740&quot;:276}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">These include holding an <\/span><b><span data-contrast=\"auto\">office of profit, being of unsound mind or insolvent, or not being a citizen of India.\u00a0<\/span><\/b><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559740&quot;:276}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">It also <\/span><b><span data-contrast=\"auto\">authorises Parliament to make law <\/span><\/b><span data-contrast=\"auto\">determining conditions of disqualifications. There are analogous provisions for members of state legislatures.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559740&quot;:276}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">The <\/span><b><span data-contrast=\"auto\">Representation of the People Act, 1951<\/span><\/b><span data-contrast=\"auto\"> provides that a person will be disqualified if<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559740&quot;:276}\">\u00a0<\/span><span data-contrast=\"auto\">convicted and sentenced to imprisonment for two years or more. They have been provided a period of three months from the date of conviction to appeal. The disqualification will not be applicable until the<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559740&quot;:276}\">\u00a0<\/span><span data-contrast=\"auto\">appeal is decided.\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559740&quot;:276}\">\u00a0<\/span><\/p>\n<h2><b><span data-contrast=\"auto\">What are the judgements of higher courts on disqualification?<\/span><\/b><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559740&quot;:276}\">\u00a0<\/span><\/h2>\n<p><span data-contrast=\"auto\">The<\/span><b><span data-contrast=\"auto\"> differential treatment of candidates <\/span><\/b><span data-contrast=\"auto\">for elections and sitting members were challenged under <\/span><b><span data-contrast=\"auto\">Article 14.<\/span><\/b><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559740&quot;:276}\">\u00a0<\/span><span data-contrast=\"auto\">The<\/span><b><span data-contrast=\"auto\"> Supreme Court in K. Prabhakaran vs P. Jayarajan case<\/span><\/b><span data-contrast=\"auto\"> decided that the consequences of disqualifying a contestant and a sitting member were different.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559740&quot;:276}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">In the case of sitting members, the strength of the party in the legislature would change. It could have an adverse impact if a government had a <\/span><b><span data-contrast=\"auto\">thin majority<\/span><\/b><span data-contrast=\"auto\">. It would also <\/span><b><span data-contrast=\"auto\">trigger a by-election. <\/span><\/b><span data-contrast=\"auto\">Therefore, it was reasonable to treat the two categories differently.\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559740&quot;:276}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">It stated that disqualification would be removed with <\/span><b><span data-contrast=\"auto\">retrospective effect<\/span><\/b><span data-contrast=\"auto\"> as this would require the cancellation of election results. Therefore, the removal of disqualification would be <\/span><b><span data-contrast=\"auto\">prospective and for future elections.<\/span><\/b><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559740&quot;:276}\">\u00a0<\/span><\/p>\n<p><b><span data-contrast=\"auto\">Supreme Court in Lily Thomas vs Union of India case, 2013<\/span><\/b><span data-contrast=\"auto\">\u00a0stated that <\/span><b><span data-contrast=\"auto\">Article 102 empowers Parliament<\/span><\/b><span data-contrast=\"auto\"> to make law regarding the disqualification of a person. If Parliament could specify conditions for disqualification, those conditions <\/span><b><span data-contrast=\"auto\">would apply equally<\/span><\/b><span data-contrast=\"auto\"> to candidates and sitting members.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559740&quot;:276}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">If a Member of Parliament was disqualified<\/span><b><span data-contrast=\"auto\"> under Article 102<\/span><\/b><span data-contrast=\"auto\">, his seat shall become vacant.
