{"id":229326,"date":"2023-03-01T20:24:05","date_gmt":"2023-03-01T14:54:05","guid":{"rendered":"https:\/\/blog.forumias.com\/?p=229326"},"modified":"2023-03-01T20:24:05","modified_gmt":"2023-03-01T14:54:05","slug":"international-courts-and-climate-change","status":"publish","type":"post","link":"https:\/\/forumias.com\/blog\/international-courts-and-climate-change\/","title":{"rendered":"International courts and climate change"},"content":{"rendered":"\n<p><strong>Source<\/strong>&#8211; The post is based on the article <strong>\u201cInternational courts and climate change\u201d <\/strong>published in <strong>The Hindu <\/strong>on <strong>1st March 2023<\/strong>.<\/p>\n<p><strong>Syllabus: <\/strong>GS2- International relations<\/p>\n<p><strong>Relevance:<\/strong> Legal issues related to climate change<\/p>\n<p><strong>News-<\/strong> A group of 16 countries led by Vanuatu seeks an advisory opinion from the International Court of Justice on the issue of climate change.<\/p>\n<p><strong>What are the various jurisdictions of ICJ? <\/strong>The ICJ has two types of jurisdictions: <strong>contentious and advisory. <\/strong><\/p>\n<p><strong>Contentious jurisdiction<\/strong>&#8211; It refers to <strong>resolving legal disputes<\/strong> between consenting states,<\/p>\n<p><strong>Advisory jurisdiction<\/strong>&#8211; Under it, the UN General Assembly, the Security Council and other specialised bodies of the UN can request the ICJ for an <strong>opinion on a legal question. <\/strong><\/p>\n<p>Unlike contentious jurisdiction, the ICJ\u2019s advisory opinions are <strong>non-binding<\/strong>. Yet, they carry <strong>normative weigh<\/strong>t and clarify international law on a relevant issue.<\/p>\n<h2><strong>What are the legal opinions sought by Vanuatu from in its draft resolution?<\/strong><\/h2>\n<p><strong>First, <\/strong>what are the <strong>international law obligations of countries<\/strong> toward the protection of the climate system from anthropogenic emissions of greenhouse gases?<\/p>\n<p>ICJ will not only <strong>interpret and clarify the existing international climate change law<\/strong> but also use the <strong>general and customary international law<\/strong> to fill the gaps in these treaties. Thus, the ICJ can use the \u2018no-harm\u2019 principle.<\/p>\n<p><strong>Second,<\/strong> what are the <strong>legal consequences for states<\/strong> that have caused significant harm to the climate system, the SID states and other people of the present and future generations?<\/p>\n<p>This question seeks to determine the price that states should pay for not honouring their <strong>international legal obligations on climate change<\/strong>. As part of <strong>climate justice,<\/strong> there is a long-standing demand for <strong>climate reparations<\/strong>.<\/p>\n<p>The rich countries have historically caused maximum greenhouse gas emissions. They should <strong>compensate developing countries<\/strong> that are disproportionately impacted by climate change.<\/p>\n<p>They have sought the advisory opinion of the <strong>International Tribunal for the Law of the Sea <\/strong>(ITLOS).<\/p>\n<p>ITLOS has been requested to determine the <strong>specific obligations <\/strong>of the countries under the <strong>UN Convention on the Law of the Sea<\/strong> about <strong>preventing and reducing pollution of the marine environment<\/strong>. The challenges of ocean warming, sea level rise and ocean acidification are all linked to the marine environment.<\/p>\n<h2><strong>What should be the approach of the international community towards the advisory jurisdiction of ICJ on climate change?<\/strong><\/h2>\n<p>These advisory opinions are not a panacea. They may even turn out to be <strong>double edged swords <\/strong>depending on the kind of verdict delivered.<\/p>\n<p>The <strong>role of international court<\/strong>s should be welcomed. Developed countries and groupings like the G\u00ad20 should support these laudable initiatives of the SID states.<\/p>\n<p><strong>Environment and climate sustainability<\/strong> are important themes of G\u00ad20.
