For example:<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u2013 In the Rafale aircraft case, the court accepted the government\u2019s argument that the matter pertained to the Official Secrets Act.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u2013 While refusing to stay the arrest of activists held in the Bhima-Koregaon case, it relied on \u201cevidence\u201d submitted by the Maharashtra police in a sealed envelope.<\/span><\/p>\n<h2><b>What is the problem with <\/b><b>sealed cover jurisprudence?<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">In \u2018<\/span><b>Cdr Amit Kumar Sharma v Union of India<\/b><span style=\"font-weight: 400;\">\u2019, the Supreme Court said that the non-disclosure of relevant material to the affected party and its disclosure in a sealed cover to the adjudicating authority sets a dangerous precedent. It perpetuates two problems:<\/span><\/p>\n<p><b>Firstly<\/b><span style=\"font-weight: 400;\">, it denies the aggrieved party their legal right to effectively challenge an order since the adjudication of issues has proceeded on the basis of unshared material provided in a sealed cover.<\/span><\/p>\n<p><b>Secondly<\/b><span style=\"font-weight: 400;\">, it perpetuates a culture of opaqueness and secrecy.
