What is \u2018Statutory bail\u2019?<\/strong><\/p>\n

Ordinarily, after the arrest of the accused, the statutory period for the State to complete investigation and file a charge sheet<\/strong> is a maximum of 90 days<\/strong> in offences punishable with life imprisonment or death. However, under some laws, like UAPA, this period can be extended up to 180 days.<\/p>\n

As per law, once the maximum period,<\/strong> (i.e., 90 \/ 180 days from arrest), provided for an investigation in a case is over and no charge sheet is filed<\/strong>, the accused becomes entitled to be released on bail, which is called the ‘default’ bail’<\/strong>. This default bail is also known as \u2018Statutory bail\u2019<\/strong>.<\/p>\n

Is it a Fundamental right or a Statutory right?<\/strong><\/p>\n

According to the Supreme Court, \u2018Statutory bail\u2019\u00a0is a Fundamental right and is a\u00a0part of the Right to personal liberty under Article 21<\/strong> of the Indian Constitution. The rationale here is that the right of the accused to seek liberty takes precedence<\/strong> over the right of the State to carry on the investigation beyond a stipulated time limit (varies for different laws).<\/p>\n

The confusion might arise due to the name itself – ‘Statutory’ Bail. As this right was given by a statute (Section 167 of CrPC<\/strong>), it was a statutory right to begin with. However, SC in Bikramjit Singh vs State of Punjab (2020)<\/strong>\u00a0and\u00a0Fakhrey Alam vs\u00a0State of UP (2021)<\/strong>\u00a0declared statutory bail under the\u00a0first proviso<\/em>\u00a0to\u00a0Section 167(2)\u00a0of CrPC a\u00a0fundamental\u00a0right.<\/p>\n

  1. Though it is a Fundamental right, it comes into place only after the stipulated time limit for investigation\u00a0has expired<\/strong>.<\/li>\n
  2. It does not prohibit or otherwise prevent the arrest or re-arrest<\/strong> of the petitioner on cogent grounds.<\/li>\n<\/ol>\n
