{"id":235010,"date":"2023-03-29T19:27:18","date_gmt":"2023-03-29T13:57:18","guid":{"rendered":"https:\/\/blog.forumias.com\/?p=235010"},"modified":"2023-03-29T19:27:18","modified_gmt":"2023-03-29T13:57:18","slug":"a-disturbing-example-of-the-normalisation-of-lawfare","status":"publish","type":"post","link":"https:\/\/forumias.com\/blog\/a-disturbing-example-of-the-normalisation-of-lawfare\/","title":{"rendered":"A disturbing example of the normalisation of lawfare"},"content":{"rendered":"\n<p><strong>Source<\/strong>&#8211; The post is based on the article <strong>\u201cA disturbing example of the normalisation of lawfare\u201d <\/strong>published in <strong>\u201cThe Hindu\u201d <\/strong>on <strong>25th <sup>\u00a0<\/sup>March 2023<\/strong>.<\/p>\n<p><strong>Syllabus: <\/strong>GS3- Polity &#8211; Parliament and State legislatures\u2014structure, functioning, conduct of business<\/p>\n<p><strong>Relevance<\/strong>&#8211; Issues related to disqualification of representatives<\/p>\n<p><strong>News<\/strong>&#8211; Recently, Rahul Gandhi was disqualified from the membership of Lok Sabha after two year imprisonment in defamation case.<\/p>\n<h2><strong>What are issues with the court judgement in the defamation case of Rahul Gandhi?<\/strong><\/h2>\n<p><strong>Legal reasoning<\/strong>&#8211; The complainant claimed that by virtue of his surname, he and all other people having surname \u201cModi\u201d had been defamed by Mr. Gandhi\u2019s remark.<\/p>\n<p>The<strong> law of defamation<\/strong> is clear that if references are made to an <strong>indefinite \u201cclass\u201d of people<\/strong>, an individual cannot claim that they are a member of that class. Therefore, they have been defamed.<\/p>\n<p>For example, if I say that \u201call lawyers are thieves\u201d, a lawyer cannot come to court and say that they have been defamed.<\/p>\n<p>The \u201cclass of all persons in the world bearing the surname Modi\u201d is a <strong>indefinite and indeterminate group. <\/strong><\/p>\n<p><strong>Quantum of the sentence<\/strong>&#8211; Criminal defamation has a maximum penalty of two years\u2019 imprisonment. This \u2018maximum penalty\u2019 is very rarely awarded. Defamation is a <strong>pure speech offence. <\/strong><\/p>\n<p>People should not be imprisoned for lengthy periods purely on the <strong>basis of their statement. <\/strong>There are almost<strong> no recorded instances<\/strong> of courts awarding the maximum sentence of two<\/p>\n<p>years in a criminal defamation case.<\/p>\n<p>The quantum of sentence was exactly that which was needed to attract an MP\u2019s disqualification from Parliament. Indeed, immediately after the judgement, Mr. Gandhi was disqualified. At that point, the judgement had not even been translated.<\/p>\n<h2><strong>Why disqualification proceedings against Rahul Gandhi is not good for India parliamentary democracy?<\/strong><\/h2>\n<p>The disqualification proceedings are another example of <strong>delegitimizing the opponent<\/strong>. The Representation of the People Act provides for disqualification.<\/p>\n<p>Disqualifying an elected member of a legislature is an<strong> extremely serious action<\/strong> in a parliamentary democracy. It leaves them <strong>without representation<\/strong> until a by-election is announced and the seat is filled.<\/p>\n<p>For this reason, the Representation of the People Act kept a parliamentarian\u2019s disqualification in abeyance until at least one appellate body <strong>could scrutinise<\/strong> the initial order of conviction.<\/p>\n<h2><strong>Why striking down provisions related to the three month period given to the legislature for appeal in the Lily Thomas case affects the political process?<\/strong><\/h2>\n<p>The Supreme Court reasoned that the convicted politician could always move the appellate court for a stay upon their conviction. However, this interpretation <strong>concentrates more power<\/strong> in the hands of courts when it comes to the political process.<\/p>\n<p>The Lok Sabha Secretariat issued the <strong>disqualification order<\/strong> before the convicted individual\u2019s lawyers moved for a stay. So, the<strong> protection<\/strong> the Court thought was available is <strong>not sufficient.<\/strong><\/p>\n<p>The Lily Thomas judgement is just one of many examples where the Supreme Court has <strong>intervened in the political process<\/strong>.
