GS2- E-governance<\/p>\n<p><strong>Relevance<\/strong>&#8211; Issues related to regulation of digital space<\/p>\n<p><strong>News<\/strong>&#8211; The Digital Personal Data Protection (DPDP) Bill 2022 was proposed recently. It provides a framework to safeguard citizens\u2019 information from misuse and unauthorised access.<\/p>\n<h2><strong>What is the approach followed by the Digital Personal Data Protection Bill 2022?<\/strong><\/h2>\n<p>The current draft of the Bill tries to tackle the issue of <strong>conflicting sectoral regulations<\/strong>. It states that the provisions of the Bill will <strong>complement and not create exemptions<\/strong> from existing regulations. But, in case of conflict, the Bill will take precedence.<\/p>\n<p>The Bill raises concerns about <strong>sectoral regulations<\/strong> that may go beyond what the Bill provides.<\/p>\n<h2><strong>What is the importance of sectoral expertise?<\/strong><\/h2>\n<p><strong>Data protection and privacy<\/strong> are highly dependent on <strong>context,<\/strong> including the type of data collected, how it is collected, the intended use and the associated risks. This makes<strong> sectoral expertise<\/strong> crucial to<strong> regulate effectively<\/strong>.<\/p>\n<p>Sectoral expertise offers a deep understanding of a particular sector, including its <strong>market dynamics, technologies, risks and business models<\/strong>. It also enables regulators to <strong>engage with stakeholders and industry experts <\/strong>in a well informed and productive manner.<\/p>\n<h2><strong>What are the major approaches adopted by the global community to regulate privacy and protect data?<\/strong><\/h2>\n<p>They are comprehensive legislation and sector \u00adspecific regulations.<\/p>\n<p><strong>Comprehensive approach<\/strong>&#8211; The<strong> European Union\u2019s General Data Protection Regulation<\/strong> is the comprehensive approach.<\/p>\n<p>The GDPR, despite being a<strong> comprehensive framewor<\/strong>k, has specific provisions for certain industries such as health care.<\/p>\n<p>GDPR also permits EU Member States to implement measures which go beyond the provisions given in the GDPR. For example, Germany has stricter provisions compared to the GDPR.<\/p>\n<p>The <strong>European Data Protection Board<\/strong> is made up of representatives from each EU member state\u2019s data protection authority. It provides<strong> guidance on the implementation and interpretation <\/strong>of the GDPR, including sector specific issues.<\/p>\n<p><strong>Sectoral approach<\/strong>&#8211; The sectoral approach is <strong>followed in the United States<\/strong>. It is seen through laws such as the Health Insurance Portability and Accountability Act in health care, and the Gramm\u00adLeach\u00adBliley Act\u00a0 for the financial sector. It consists of <strong>regulations tailored to specific industries.<\/strong><\/p>\n<h2><strong>What are issues with the American sectoral approach to data protection?<\/strong><\/h2>\n<p>There are issues related to<strong> inconsistent protection, problems in enforcement, overlapping and contradictory provisions, and a lack of federal regulation.<\/strong><\/p>\n<p>This creates confusion and coverage gaps for businesses. There is<strong> no centralised authority <\/strong>to enforce data protection laws. It leads to a<strong> lack of standardisation. <\/strong><\/p>\n<h2><strong>What is the way forward for regulation of data in India?<\/strong><\/h2>\n<p>The GDPR model may not work for India as the The Data Protection Board is designed as a <strong>grievance agency, and not as a regulator.<\/strong><\/p>\n<p>The current draft of the Bill needs<strong> greater clarity and specificity <\/strong>regarding the interaction with sectoral regulations. There is a need to draw from our experience to find the right balance.<\/p>\n<p>In India, we already have sectoral regulations regarding data protection such as the Reserve Bank of India\u2019s directive on storage of payment data. These are the result of<strong> extensive industry consultations and expert input. <\/strong><\/p>\n<p>Neglecting these regulations and establishing a new framework would<strong> undermine the considerable effort<\/strong> invested in their creation. It will require the industry to<strong> readjust their<\/strong><\/p>\n<p><strong>operations <\/strong>again at considerable cost.<\/p>\n<p>The DPDP Bill\u00a0 must serve as the <strong>minimum layer of protection<\/strong>, with sectoral regulators having the ability to build on these protections.<\/p>\n<p>Data protection is a<strong> complex subject.<\/strong> There is a need to create room for <strong>sectoral experts<\/strong> to <strong>safeguard the interests of citizens <\/strong>more effectively.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Source&#8211; The post is based on the article \u201cUnderstanding the street dogs-human conflict\u201d published in \u201cThe Hindu\u201d on 29th March 2023.
