{"id":236437,"date":"2023-04-06T20:28:40","date_gmt":"2023-04-06T14:58:40","guid":{"rendered":"https:\/\/blog.forumias.com\/?p=236437"},"modified":"2023-04-13T13:43:10","modified_gmt":"2023-04-13T08:13:10","slug":"supreme-court-says-critical-views-on-government-policies-not-anti-establishment","status":"publish","type":"post","link":"https:\/\/forumias.com\/blog\/supreme-court-says-critical-views-on-government-policies-not-anti-establishment\/","title":{"rendered":"Supreme Court says critical views on government policies not anti-establishment"},"content":{"rendered":"\n<p><b>Source: <\/b><span style=\"font-weight: 400;\">The post is based on the article <\/span><b>\u201cSupreme Court says critical views on government policies not anti-establishment\u201d<\/b><span style=\"font-weight: 400;\"> published in<\/span><b> The Hindu <\/b>on <b>6th April 2023<\/b><\/p>\n<h2><b>What is the News?<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">The Supreme Court has quashed the Union government\u2019s telecast ban on the Malayalam news channel.<\/span><\/p>\n<h2><b>What was the case about?<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">The Ministry of Information and Broadcasting had refused to renew the broadcast license of the news channel on the ground that the Ministry of Home Affairs had declined (based on IB report) security clearance over alleged links with the Jamaat-e-Islami-Hind (JEIH).<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The channel approached the Kerala High Court(HC) against the Centre\u2019s action, which upheld the ban on the channel on the grounds of national security.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The Supreme Court set aside the Kerala HC order and directed that the license be renewed in four weeks&#8217; time.<\/span><\/p>\n<h2><b>What were the observations made by the court while delivering the judgment?<\/b><\/h2>\n<p><b>Restricts freedom of the press:<\/b><span style=\"font-weight: 400;\"> The government\u2019s refusal to renew the broadcast license of the Malayalam channel amounted to restricting the freedom of the press.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u2013 An independent press is vital for the robust functioning of a democratic republic.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u2013 SC also held that criticism of government policy does not constitute a reasonable restriction under Article 19(2) of the Constitution.<\/span><\/p>\n<p><b>National Security:<\/b><span style=\"font-weight: 400;\"> The court refused to accept the government\u2019s national security argument to deny the license.\u00a0<\/span><span style=\"font-weight: 400;\">The court held that national security claims cannot be made out of thin air. There must be material backing such inference.<\/span><\/p>\n<p><b>Sealed cover jurisprudence: <\/b><span style=\"font-weight: 400;\">The court disapproved the \u201csealed cover\u201d procedure.
