GS3- Security<\/p>\n<p><strong>Relevance<\/strong>&#8211; Issues related to criminal justice system, and law &amp; order<\/p>\n<p><strong>News<\/strong>&#8211; The India Justice Report of 2022 was recently released by Tata Trusts.<\/p>\n<h2><strong>What are the main highlights of\u00a0 India Justice Report, 2022?<\/strong><\/h2>\n<p><strong>Pending cases in courts<\/strong>&#8211; Covid has slowed down the <strong>pace of case-clearance<\/strong> by courts. Pending cases increased from <strong>41 million in 2020 to 49 million in 2022<\/strong>. India has 5.6 million pending for longer than a decade and 190,000 cases pending for over 30 years.<\/p>\n<p><strong>Lack of judicial strength<\/strong>&#8211; The judiciary has a <strong>lack of capacity. <\/strong>There are a total of 20,093 judges at work. There exist <strong>15 judges for every million Indians<\/strong>. It is less than a third of the <strong>50 recommended by the Law Commission in 1987. <\/strong><\/p>\n<p><strong>Overcrowding of prisons<\/strong>&#8211; There has been a sharp rise in <strong>overcrowding of Indian prisons. <\/strong>There are <strong>30 extra inmates<\/strong> in 2021 for an existing capacity of 100. 77% of them were <strong>under-trials<\/strong>. It is up from about 69% two years earlier.<\/p>\n<p>It violates the norm of <strong>\u201cbail not jail\u201d<\/strong> and shows the <strong>lack of apathy.<\/strong><\/p>\n<p><strong>Policing issues<\/strong>&#8211; The report highlights the issues related to police forces. There exist <strong>state-wise variation<\/strong> on several counts, like <strong>vacancies, training budgets, police station cameras.\u00a0 <\/strong><\/p>\n<p>Except in Union territories governed by the Centre, law-enforcers operate directly under state governments. So politics has a <strong>structural role<\/strong> in justice delivery.<\/p>\n<p><strong>Lack of police diversity<\/strong> is a common problem across states. There is a<strong> lack of participation<\/strong> on the basis of gender, caste or other markers of identity. It can<strong> lead to biases.<\/strong><\/p>\n<p><strong>Women cops<\/strong> are in shortages. All police stations are supposed to have<strong> women\u2019s helpdesks. <\/strong>But, 28% do not have this facility and many others don\u2019t have women cops ready to respond.<\/p>\n<p>There is a<strong> lack of autonomy<\/strong> for the police. politicians are reluctant to\u00a0 empower police officers.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Source&#8211; The post is based on the article \u201cWe need reforms that\u2019ll ensure justice prevails\u201d published in the \u201cThe Hindu\u201d on 5th April 2023.
