Source<\/span><\/b>: The post is based on the article <\/span>\u201c<\/span><\/b>The LoC agreement of 2007 deserves a relook<\/span><\/b>\u201d <\/span><\/b>published in <\/span>\u201cThe Hindu\u201d <\/span><\/b>on <\/span>22nd April 2023<\/span><\/b>.<\/span>\u00a0<\/span><\/p>\n Syllabus: <\/span><\/b>GS 2- Bilateral groupings and agreements<\/span>\u00a0<\/span><\/p>\n Relevance<\/span><\/b>: India – Pakistan bilateral issues<\/span>\u00a0<\/span><\/p>\n News<\/span><\/b>: A former Special Envoy has confirmed in his book that the agreement<\/span> on the Line of Control (LoC) in Kashmir, was ready to be signed by then Prime Minister<\/span>\u00a0<\/span>Manmohan Singh and Pakistan President General Musharraf.<\/span> But, the stand-off in Pakistan with the judiciary and the 26\/11 attacks in 2008 has halted its progress.<\/span><\/p>\n The agreement proposed a <\/span>\u201c4-point solution\u201d and a \u201c14 \u00adpoint set of guidelines\u201d <\/span><\/b>for any settlement between the two countries. It includes <\/span>free flow of trade, ending cross border terrorism, respect for human rights, and bringing down military presence<\/span><\/b> on both sides of the LoC<\/span>\u00a0<\/span><\/p>\n The Line of Control has to be <\/span>respected like a normal border <\/span><\/b>between the two countries.\u00a0<\/span>\u00a0<\/span><\/p>\n A <\/span>series of terror attacks,<\/span><\/b> from Mumbai to Pathankot and Pulwama has spoiled the relationship.<\/span> The reorganisation of Jammu and Kashmir <\/span><\/b>in August 2019, and the <\/span>amendment to Article 370<\/span><\/b> have made it difficult for any Pakistani leader to propose a<\/span> restoration of ties.\u00a0<\/span><\/b>\u00a0<\/span><\/p>\n There are <\/span>no political contacts<\/span><\/b> at any level, <\/span>no trade, no direct travel links and no High Commissioners<\/span><\/b> in each other\u2019s countries.<\/span>\u00a0<\/span><\/p>\n Prime Minister continued to seek engagement with Islamabad even after the several setbacks,<\/span><\/p>\n Back\u00adchannel talks<\/span><\/b> are believed to run between National Security Adviser and Pakistani intelligence. It focuses on <\/span>preventing hostilities. <\/span><\/b>The LoC ceasefire agreement of 2021 was the result of it.<\/span>\u00a0<\/span><\/p>\n The two sides have also discussed measures that would lead to the <\/span>restoration<\/span><\/b> of statehood<\/span><\/b> and elections in J&K, the <\/span>reappointment of High Commissioners<\/span><\/b> and the <\/span>restoration of visas and people-to-people ties.\u00a0 <\/span><\/b>\u00a0<\/span><\/p>\n These include initiatives such as the <\/span>Kartarpur Corridor <\/span><\/b>and the proposed <\/span>Sharda Peeth Corrido<\/span><\/b>r across the temple in Pakistan Occupied Kashmir\u2019s Neelum Valley.<\/span> \u00a0<\/span><\/p>\n The next step would be to revisit the <\/span>nearly ready agreement<\/span><\/b> of 15 years ago.\u00a0<\/span>\u00a0<\/span><\/p>\n New Delhi\u2019s moves to revoke J&K\u2019s special status and Statehood did not change the <\/span>basis for a settlement<\/span><\/b> of the J&K dispute. Article 370 was always a <\/span>temporary provision<\/span><\/b>, and diluted over the decades. It was never recognised by Pakistan.<\/span>\u00a0<\/span>Article 35(A) has had little to no effect in <\/span>changing demography<\/span><\/b> thus far.<\/span>\u00a0<\/span><\/p>\n The <\/span>move on gender parity<\/span><\/b> in property inheritance had already been implemented in 2002. The move related to<\/span> downgrading the State to a Union Territory<\/span><\/b> will be reversed.<\/span>\u00a0<\/span><\/p>\n Unjust arrests<\/span><\/b> and a continuing s<\/strong><\/span>e<\/strong>curity crackdown on politicians and civil society <\/span><\/b>in J&K should be stopped. There is a need to relook at measures like<\/span> internet bans and a stringent lockdown<\/span><\/b>, <\/span>targeting of journalists<\/span><\/b> and<\/span> human rights violations.\u00a0<\/span><\/b>\u00a0<\/span><\/p>\n There is a need to end <\/span>cross-border terrorism<\/span><\/b> from Pakistan that the people of J&K, have suffered from for decades.<\/span>\u00a0<\/span><\/p>\n Despite the precarious situation within J&K, the LoC has been <\/span>more or less stable<\/span><\/b> for more than half a century. Any military operation by either India or Pakistan to reclaim the other side is unlikely to make much headway.\u00a0<\/span>\u00a0<\/span><\/p>\n Pakistan is <\/span>facing internal crises.<\/span><\/b> China at the Line of Actual Control<\/span><\/b> is a bigger challenge for India.
