{"id":240812,"date":"2023-05-03T20:30:39","date_gmt":"2023-05-03T15:00:39","guid":{"rendered":"https:\/\/blog.forumias.com\/?p=240812"},"modified":"2023-05-03T20:30:39","modified_gmt":"2023-05-03T15:00:39","slug":"outlawing-indias-tech-tariffs","status":"publish","type":"post","link":"https:\/\/forumias.com\/blog\/outlawing-indias-tech-tariffs\/","title":{"rendered":"Outlawing India\u2019s tech tariffs"},"content":{"rendered":"\n<p><strong>Source<\/strong>&#8211; The post is based on the article <strong>\u201cOutlawing India\u2019s tech tariffs\u201d <\/strong>published in \u201c<strong>The Hindu\u201d <\/strong>on <strong>3rd May 2023<\/strong>.<\/p>\n<p><strong>Syllabus: <\/strong>GS 3 \u2013 Indian Economy \u2013 International Trade<\/p>\n<p><strong>News- <\/strong>World Trade Organization dispute settlement panels have found India\u2019s tariffs on certain information and communication technology products such as mobile phones inconsistent with India\u2019s WTO obligations.<\/p>\n<h2><strong>What are WTO provisions regarding the imposing of tariffs by countries?<\/strong><\/h2>\n<p>WTO member countries are under a <strong>legal obligation<\/strong> not to impose tariff rates more than their maximum tariff rates committed in their <strong>Goods Schedule<\/strong>. The <strong>Goods Schedules<\/strong> are based on the <strong>World Customs Organization\u2019s classification system<\/strong>.<\/p>\n<p><strong>World Customs Organization\u2019s classification system<\/strong> catalogues traded products with specific names and numbers. This is also known as the <strong>Harmonized System of Nomenclature (HSN). <\/strong><\/p>\n<p>Due to the continuous emergence of new products owing to technological innovations, the HSN system is <strong>regularly updated <\/strong>to reflect new products. It is known as <strong>\u2018transposition\u2019<\/strong>.<\/p>\n<h2><strong>What is the reasoning by the panel on arguments represented by India in its favour?<\/strong><\/h2>\n<p>First, India argued that its binding tariff commitments on ICT products are contained in the <strong>WTO Ministerial Declaration on Trade in Information Technology Products (ITA Agreement)<\/strong>.<\/p>\n<p>The ITA Agreement is an arrangement through which select WTO member countries agree to <strong>eliminate duties on IT products.<\/strong><\/p>\n<p>However, as per the panel, Commitments under the ITA <strong>become binding<\/strong> on a country under <strong>Articles II of GATT<\/strong> only if they are incorporated in the<strong> Goods Schedule<\/strong>. India\u2019s Goods Schedule, not the ITA, is the source of India\u2019s <strong>legal obligations on tariffs<\/strong>, including on products covered by the ITA.<\/p>\n<p>Second, India argued that an error was committed during the <strong>transposition of its Goods <\/strong>Schedule from the<strong> HSN 2002 edition to the HSN 2007 edition. <\/strong>Therefore, an error in a treaty would <strong>invalidate a state\u2019s consent, as per Article 48 of the Vienna Convention on Law of Treaties.<\/strong><\/p>\n<p>However, WTO has also denied accepting this argument based on few technicalities.<\/p>\n<h2><strong>What are the options for India?<\/strong><\/h2>\n<p>It is unlikely that India<strong> will comply<\/strong>. Compliance would remove the <strong>high protective tariff <\/strong>imposed by India to boost domestic manufacturing of ICT products.<\/p>\n<p>India is likely to appeal against the panel ruling. However, the <strong>Appellate Body<\/strong> that hears appeals has ceased to exist since 2019 because the United States has been <strong>blocking the appointment<\/strong> of the body\u2019s members.<\/p>\n<p>Thus, India\u2019s appeal will <strong>go into the void<\/strong>. Legally, India will not be required to comply with the panel rulings till the time its appeal is heard.<\/p>\n<h2><strong>What are options before the EU?<\/strong><\/h2>\n<p>Under the WTO law, the EU cannot <strong>cannot impose sanctions<\/strong>. The WTO law does not allow countries to impose trade sanctions when an <strong>appeal is pending<\/strong>.<strong> Retaliatory action<\/strong> in the form of trade sanctions can be imposed only after the <strong>authorisation of the Dispute Settlement Body.<\/strong><\/p>\n<p>The EU and a few other WTO member countries have created an <strong>alternative appellate mechanism <\/strong>\u2014 the <strong>Multi-Party Interim Appeal Arbitration Arrangement (MPIA)<\/strong>.
