{"id":241203,"date":"2023-05-06T20:28:17","date_gmt":"2023-05-06T14:58:17","guid":{"rendered":"https:\/\/blog.forumias.com\/?p=241203"},"modified":"2023-05-06T20:28:17","modified_gmt":"2023-05-06T14:58:17","slug":"delhi-demolitions-under-the-cloak-of-law","status":"publish","type":"post","link":"https:\/\/forumias.com\/blog\/delhi-demolitions-under-the-cloak-of-law\/","title":{"rendered":"Delhi demolitions: Under the cloak of law"},"content":{"rendered":"\n<p><strong>Source<\/strong>&#8211; The post is based on the article <strong>\u201cDelhi demolitions: Under the cloak of law\u201d <\/strong>published in <strong>\u201cThe Indian Express\u201d <\/strong>on <strong>6th May 2023<\/strong>.<\/p>\n<p><strong>Syllabus: <\/strong>GS1- Urbanisation<\/p>\n<p><strong>Relevance<\/strong>&#8211; Issues related to urban planning<\/p>\n<p><strong>News<\/strong>&#8211; The periodic drama of demolitions of illegal construction has become the unfortunate event of Delhi\u2019s development.<\/p>\n<h2><strong>What are issues with demolition drives in Delhi?<\/strong><\/h2>\n<p>The need to demolish is portrayed as a<strong> law and order issue<\/strong>, not the <strong>failure of urban planning.<\/strong><\/p>\n<p>The judiciary has <strong>emerged as the arbiter<\/strong> in the field because the demolition is presented as the <strong>illegal use of land<\/strong> defined by the <strong>Master Plan of Delhi. <\/strong><\/p>\n<p>This hides the <strong>inadequacies of MPD<\/strong>. It is unable to meet the <strong>needs of all the residents<\/strong>. These <strong>inadequacies of MPD<\/strong> need to be analysed by the creators of MPD, and not the judiciary.<\/p>\n<p>All over the world, urban planners have shown<strong> pragmatic creativity<\/strong> to resolve problems related to the m<strong>anagement of their cities<\/strong>. They have not used the <strong>police powers of the state.<\/strong> This is not the case with Delhi.<\/p>\n<p>For example, the development of slums, mushrooming commercial, retail and industrial activities, are all evidence of a robustly <strong>developing political economy. <\/strong><\/p>\n<p>Urban planners of Delhi have not mediated this process by modifying the MPD in subsequent revisions. They have treated it as an <strong>urban malaise<\/strong> that needs to be eradicated.<\/p>\n<p>As a result, the city today is not so much the product of the<strong> original vision of MPD. <\/strong>It is the product of the <strong>contest between the haves and the have-nots. <\/strong><\/p>\n<p>Those facing the police have naturally <strong>appealed to politicians<\/strong> for relief. They have used corrupt means to <strong>\u201cregularise\u201d their initiatives<\/strong> to survive under hostile circumstances.<\/p>\n<p>As per some analysts, the process has been so pervasive that <strong>70% of the city<\/strong> has been regularised. It cast doubts on the efficacy of <strong>demolition as an urban planning strategy. <\/strong>Demolitions have only shifted the focus from the <strong>original source of the problem, th<\/strong>at is flawed MPD.<\/p>\n<h2><strong>What are issues with urban planning in India?<\/strong><\/h2>\n<p>The<strong> spatial norms, development controls,<\/strong> and even the <strong>basic planning ideology <\/strong>that are the basis of the Master Plan of Indian cities are modelled on <strong>urban development strategies of Europe and the US<\/strong>. They have different <strong>social, economic and cultural circumstances. <\/strong><\/p>\n<p>These were adopted after Independence by the <strong>governing elite <\/strong>because they <strong>matched with their aspirations <\/strong>for creating modern Indian cities.<\/p>\n<p>This model has proved inadequate to handle the <strong>complex problems of Indian urbanisation<\/strong>. It is unable to deal with the <strong>nature of indigenous urbanism<\/strong> that fulfils the <strong>expectations of new migrants<\/strong>:<\/p>\n<h2><strong>What is the way forward for urban planning in India?<\/strong><\/h2>\n<p>The mindset of urban planners, civic authorities and the police must change. They must understand that they are dealing with an <strong>ethical, not legal issue. <\/strong><\/p>\n<p>The success of urban planning should not be contingent on the outcome of the <strong>contest between the haves and the have-nots. <\/strong><\/p>\n<p>Aborting the attempts of the have-nots to fulfil their basic needs is not the efficacious strategy to ensure the success of urban planning.
