{"id":241491,"date":"2023-05-09T19:48:20","date_gmt":"2023-05-09T14:18:20","guid":{"rendered":"https:\/\/blog.forumias.com\/?p=241491"},"modified":"2023-05-09T19:48:20","modified_gmt":"2023-05-09T14:18:20","slug":"what-are-the-regulations-to-curtail-misleading-food-ads","status":"publish","type":"post","link":"https:\/\/forumias.com\/blog\/what-are-the-regulations-to-curtail-misleading-food-ads\/","title":{"rendered":"What are the regulations to curtail misleading food ads?"},"content":{"rendered":"\n<p><b>Source: <\/b><span style=\"font-weight: 400;\">The post is based on the articl<\/span>e<b> \u201c<\/b><b>What are the regulations to curtail misleading food ads?<\/b><b>\u201d <\/b><span style=\"font-weight: 400;\">published in <\/span><b>The Hindu <\/b>on <b>9th May 2023<\/b><\/p>\n<h2><b>What is the News?<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">The Advertisement Monitoring Committee at the Food Safety and Standards Authority of India (FSSAI) flagged 32 fresh cases of food business operators (FBOs) making misleading claims and advertisements.<\/span><\/p>\n<h2><b>What does FSSAI want from the advertisements?<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">FSSAI wants advertisements and claims to be truthful, unambiguous, meaningful, not misleading and help consumers to comprehend the information provided.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The claims must be scientifically substantiated by validated methods of characterizing or quantifying the ingredient or substance that is the basis for the claim.<\/span><\/p>\n<h2><b>What are the deceptive words used in the advertisements to mislead consumers?<\/b><\/h2>\n<p><b>Natural:<\/b><span style=\"font-weight: 400;\"> A food product can be referred to as \u2018natural\u2019 if it is a single food derived from a recognised natural source and has nothing added to it.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u2013 Composite foods &#8211; a mixture of plant and processed constituents can be called \u2018made from natural ingredients\u2019 instead of \u2018natural\u2019.<\/span><\/p>\n<p><b>Fresh: <\/b><span style=\"font-weight: 400;\">It can be used for products which are not processed in any manner other than washing, peeling, chilling, trimming, cutting or irradiation by ionizing radiation (not exceeding 1 kG to delay in ripening, killing of insects\/pests, etc).<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u2013 Those with additives (to increase shelf life) may instead use \u2018freshly frozen\u2019, \u2018fresh frozen\u2019, or \u2018frozen from fresh\u2019 to contextualize that it was quickly frozen while fresh.<\/span><\/p>\n<p><b>Pure and original: <\/b><span style=\"font-weight: 400;\">\u2018Pure\u2019 is to be used for single-ingredient foods to which nothing has been added and which are devoid of all avoidable contamination.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u2013 \u2018Original\u2019 is used to describe food products made to a formulation, with a traceable origin that has remained unchanged over time.<\/span><\/p>\n<p><b>Nutritional claims:<\/b><span style=\"font-weight: 400;\"> Nutritional claims may either be about the specific contents of a product or comparisons with some other foodstuff.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u2013 Claims of equivalence such as \u201ccontains the same of (nutrient) as a (food)\u201d or \u201cas much (nutrient) as a (food)\u201d may be used in the labelling.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u2013 Most complaints of misleading Ads were related to the nutrition of a product, its benefits and the ingredient mix not being based on adequate evidence<\/span><b>.<\/b><\/p>\n<h2><b>What are the regulations to combat misleading advertisements? <\/b><\/h2>\n<p><span style=\"font-weight: 400;\">There are varied regulations to combat misleading advertisements and claims:<\/span><\/p>\n<p><b>Food Safety and Standards (Advertising &amp; Claims) Regulations, 2018: <\/b><span style=\"font-weight: 400;\">It specifically deals with food (and related products). The rules <\/span><span style=\"font-weight: 400;\">prohibit companies from using deceptive words like &#8220;natural&#8221;, &#8220;fresh&#8221;, &#8220;original&#8221;, &#8220;traditional&#8221;, &#8220;premium&#8221;, &#8220;finest&#8221;, &#8220;best&#8221;, &#8220;authentic&#8221;, &#8220;genuine&#8221; and &#8220;real&#8221;.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u2013 P<\/span><span style=\"font-weight: 400;\">roduct claims suggesting a prevention, alleviation, treatment or cure of a disease, disorder or particular psychological condition is prohibited unless specifically permitted under the regulations of the FSS Act, 2006.<\/span><\/p>\n<p><b>Central Consumer Protection Authority (CCPA): <\/b><span style=\"font-weight: 400;\">It has been set up under <\/span><span style=\"font-weight: 400;\">Consumer Protection Act, 2019. It has been set up to promote, protect and enforce the rights of consumers as a class.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u2013 It is empowered to conduct investigations into violation of consumer rights and institute complaints\/prosecution, order recalls of unsafe goods and services, order discontinuation of unfair trade practices and misleading advertisements, impose penalties on manufacturers\/endorsers\/publishers of misleading advertisements.<\/span><\/p>\n<p><b>Programme and Advertising Codes prescribed under the Cable Television Network Rules, 1994: <\/b><span style=\"font-weight: 400;\">It stipulates that advertisements must not imply that the products have some special or miraculous or supernatural property or quality, which is difficult to prove.\u00a0<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Source: The post is based on the article \u201cWhat are the regulations to curtail misleading food ads?\u201d published in The Hindu on 9th May 2023 What is the News?
