{"id":242296,"date":"2023-05-13T20:00:06","date_gmt":"2023-05-13T14:30:06","guid":{"rendered":"https:\/\/blog.forumias.com\/?p=242296"},"modified":"2023-05-15T15:25:56","modified_gmt":"2023-05-15T09:55:56","slug":"diagnostic-imaging-of-the-rajasthan-right-to-health-act","status":"publish","type":"post","link":"https:\/\/forumias.com\/blog\/diagnostic-imaging-of-the-rajasthan-right-to-health-act\/","title":{"rendered":"Diagnostic imaging of the Rajasthan Right to Health Act"},"content":{"rendered":"\n<p><strong>Source<\/strong>: The post is based on the article\u00a0<strong>\u201cDiagnostic imaging of the Rajasthan Right to Health Act<\/strong>\u201d published in<strong> The Hindu <\/strong>on\u00a0<strong>13<sup>th<\/sup> May 2023<\/strong>.<\/p>\n<p><strong>Syllabus: GS 2 \u2013 Government Policies &amp; Interventions in Various Sectors<\/strong><\/p>\n<p><strong>Relevance: <\/strong>concerns associated with Rajasthan\u2019s Right to Health (RTH) Bill<\/p>\n<p><strong>News<\/strong>: The Rajasthan Right to Health (RTH) Bill has been controversial and there have been oppositions to it.<\/p>\n<h2><strong>What are some of the flaws in the Rajasthan\u2019s Right to Health (RTH) Bill?<\/strong><\/h2>\n<p><strong>Addition of extra provisions:<\/strong> \u00a0The problem with the bill is that additional changes\/amendments have been added in the bill other than those recommended by the select committee.<\/p>\n<p><strong>For instance,<\/strong> the term \u2018designated health care centres\u2019 was introduced, and a reimbursement clause for unpaid emergency care was added.<\/p>\n<p>These extra additions are praiseworthy but most other changes in the amended Bill were not beneficial in protecting public health interests.<\/p>\n<p><strong>Lack of representation of medical representatives:<\/strong> The bill initially included three representatives, from ayurveda, homoeopathy, and unani, as ex-officio members from the state health authority.<\/p>\n<p>However, <strong>the amended bill had provision for only one representative<\/strong> from the alternative medical systems, with medical education representatives filling for the remaining two.<\/p>\n<p>Further, the amended Bill swapped public health experts with Indian Medical Association (IMA) representatives as nominated members. <strong>This left state and district health authorities with little or no representation.<\/strong><\/p>\n<p><strong>Restricting powers of the administrative organs:<\/strong> The grievance redress system proposed in the initial iteration underwent a considerable change in the amended Bill.<\/p>\n<p><strong>For example,<\/strong> the grievance redress system was initially proposed to be handled through web portals, helpline centres, and officers concerned within 24 hours.<\/p>\n<p>However, <strong>patient grievances will now be handled by the concerned health-care institution <\/strong>within three days. This may lead to conflict of interests and add more burdens to the hospitals.<\/p>\n<p><strong>Lacks in public health representation:<\/strong> Health care laws should also focus on health promotion, disease prevention, and nutrition. However, the RTH does not aim to serve these purposes.<\/p>\n<p><strong>Repealing the Act:<\/strong> Some of those opposing the bill have called to repeal the law due to the ambiguous definitions of some terms such as the definition of emergency.<\/p>\n<p>However, there are ambiguities even with widely accepted medical definitions. Therefore, it is required that all parties should come together to best elaborate the definitions rather than repealing a Bill.<\/p>\n<h2><strong>What are some of the advantages of the bill?<\/strong><\/h2>\n<p>The State government has stated that private multispecialty hospitals with less than 50 beds, and those that have not received government subsidised land\/buildings, will be temporarily exempted from the bill.<\/p>\n<p>This provision of the bill was widely accepted by the doctors\u2019 associations.<\/p>\n<p><a href=\"https:\/\/forumias.com\/blog\/doctors-must-embrace-right-to-health-bill-not-protest-against-it\/\">Click Here to Read More<\/a><\/p>\n<h2><strong>What lessons can be learnt from the RTH bill of Rajasthan?<\/strong><\/h2>\n<p>The lessons learnt are &#8211; <strong>a)<\/strong> laws should be carefully drafted to avoid oppositions, <strong>b)<\/strong> the government should not get influenced by organised medical interest alone in preparing any health policy, <strong>c)<\/strong> governments and the medical community should also make themselves aware of the broader social dimensions of health and health legislation and <strong>d)<\/strong> governments should be aware that adopting such kind of legislation without being financially ready might backfire.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Source: The post is based on the article\u00a0\u201cDiagnostic imaging of the Rajasthan Right to Health Act\u201d published in The Hindu on\u00a013th May 2023.
