News<\/strong>– On May 19 this year, the Union government promulgated an ordinance<\/a> to amend the Government of National Capital Territory of Delhi (NCTD) Act, 1991. It nullified the Supreme Court judgement of May 11 on the powers over bureaucratic appointments in Delhi.<\/p>\n

The SC viewpoint on the position of Delhi in India\u2019s federal constitutional scheme?<\/strong><\/h2>\n

As per Supreme Court, Article 239AA<\/strong><\/a> in the Constitution has accorded the National Capital Territory of Delhi a \u201csui generis<\/em>\u201d status<\/strong>.<\/p>\n

The Court held that there is no \u201chomogeneous class\u201d<\/strong> of Union Territories and States. The Indian Constitution has several examples of special governance arrangements<\/strong>. These treat federal units differently from each other.<\/p>\n

India\u2019s federal system<\/strong> has been described as asymmetric due to the special status<\/strong> accorded to Jammu and Kashmir under Article 370 and special protections under Article 371, and 5th and 6th Schedule Areas.<\/strong><\/p>\n

SC used the asymmetric federalism framework<\/strong> to clarify the position of the NCTD in India\u2019s federal scheme.<\/p>\n

It remarked that though NCTD is not a full-fledged State<\/strong>. Article 239AA<\/strong> created an asymmetric federal model<\/strong> for the NCTD. The unique constitutional statu<\/strong>s conferred upon it makes it a federal entity.<\/strong><\/p>\n

For countries with deep ethnic, linguistic, and cultural differences<\/strong>, an asymmetric model of federalism<\/strong> is desirable. It accommodates the interests of various social groups <\/strong>through territorial units.<\/p>\n

The Court noted that the principles of federalism and democracy<\/strong> are interlinked. Use of legislative power by the state fulfils people\u2019s aspirations.<\/strong><\/p>\n

Federalism creates \u201cdual manifestation of the public will<\/strong>\u201d. Here, the priorities of the two sets of governments are different.<\/p>\n

Why is the presidential ordinance problematic?<\/strong><\/h2>\n

It does not augur well for judicial independence<\/strong>. The legislature can alter the legal basis <\/strong>of a judgment. But it cannot directly overrule<\/strong> it.<\/p>\n

The power of ordinance is only to meet an extraordinary situation<\/strong>. It cannot be used to serve political ends.<\/strong> The ordinance by the Union government is an act of constitutional subterfuge. <\/strong><\/p>\n

The ordinance creates a civil services authority where bureaucrats can overrule an elected Chief Minister. It destroys long-established norms on bureaucratic accountability.<\/strong><\/p>\n

For all these reasons, the ordinance is a direct assault on federalism and democracy. <\/strong><\/p>\n
