Chief Ministers feel that Governors have not acted for long period of time on Bills presented for their assent.<\/p>\n<h2><strong>What is the constitutional position of the Governor?<\/strong><\/h2>\n<p>The <strong>Legislature of a State <\/strong>comprises the Governor and the Legislative Assembly and a Legislative Council. The Governor has<strong> little autonomy<\/strong> in his functioning.<\/p>\n<p>He can act only on the \u201c<strong>advice\u201d of his Council of Ministers<\/strong>, with the Chief Minister as the head of the Council.<\/p>\n<p>However, the Governor can exercise his discretion <strong>independent of the Council of Ministers in some cases<\/strong>. As per <strong>Article 163(2) of the Constitution<\/strong>, this decision of the Governor on discretion of his cannot be challenged.<\/p>\n<p>In <strong>Shamsher Singh v State of Punjab (1974)<\/strong>, the Supreme Court held that a President or a Governor can exercise their <strong>discretion independent of their Ministers<\/strong> only where the <strong>Constitution expressly permits<\/strong> them.<\/p>\n<h2><strong>What is Governor power with respect to bills passed by the assembly?<\/strong><\/h2>\n<p><strong>Article 200<\/strong> states that the Governor can either give his <strong>assent or withhold it or return<\/strong> the Bill with certain suggestions.<\/p>\n<p>The Governor may return the Bill if it is not a Money Bill for <strong>reconsidering the Bill.<\/strong> The House has six months to decide whether or not to accept this request.<\/p>\n<p>Once the House returns the Bill to the Governor, he must <strong>give his assent <\/strong>whether or not his recommendations have been accepted.<\/p>\n<p>The Governor has discretion to <strong>refer a Bill to the President<\/strong>, if it takes away the <strong>powers of the High Court. <\/strong><\/p>\n<h2><strong>Does the Governor have discretion to indefinitely withhold assent to a Bill?<\/strong><\/h2>\n<p>In <strong>Purushothaman Nambudiri v State of Kerala<\/strong>, SC held that a Bill pending the Governor\u2019s assent would not lapse upon the <strong>dissolution of the House. <\/strong><\/p>\n<p>It held that since there is <strong>no time limit<\/strong> prescribed under <strong>Articles 200 and 201 <\/strong>for the Governor or the President to give their assent. Framers of the Constitution did not want a Bill pending assent from the Governor to lapse on <strong>dissolution of the House.<\/strong><\/p>\n<p>In <strong>Shamsher Singh case<\/strong>, the Court held that it is only with respect to the <strong>reserving the bill for Presidential assent<\/strong> that the Governor exercises <strong>discretion independent <\/strong>of the Council.<\/p>\n<p>In the <strong>Nabam Rebia case<\/strong>, the Court also held that the Governor <strong>exercises discretion<\/strong> only with regard to <strong>reservation of the bill for consideration of the President.<\/strong><\/p>\n<p>The Governor has <strong>no discretion to indefinitely withhold assent to a Bill.<\/strong> Refusing to act on a Bill is in <strong>violation of the Constitution<\/strong>.
