GS2- Judiciary<\/p>\n<p><strong>Relevance-<\/strong> Issues related to LGBT<\/p>\n<p><strong>News- <\/strong>Just a few days before the Supreme Court of India commenced hearings on the same-sex marriage issue.<\/p>\n<h2><strong>What questions arises when SC follows a liberal approach in deciding the same-sex marriages?<\/strong><\/h2>\n<p>The Court should be neutral on <strong>moral questions<\/strong> about the <strong>desirability of marriage, meaning of marriage<\/strong>. This neutrality is mandated by its<strong> jurisprudence on equality for all<\/strong> irrespective of social or personal morality.<\/p>\n<p><strong>Constitutional morality<\/strong> has been used by the Supreme Court in many cases to <strong>maintain neutrality on moral issues.<\/strong><\/p>\n<p>Following this neutrality would mean that <strong>people\u2019s legal rights<\/strong> are protected irrespective of the <strong>societies\u2019 moral view.<\/strong><\/p>\n<p>But to mandate the state to recognise a particular kind of marriage based on<strong> equality<\/strong> is to recognise marriage as a <strong>social honou<\/strong>r. It would be violating the <strong>liberal tenet of neutrality.<\/strong><\/p>\n<p>As per l<strong>iberal theory<\/strong>, <strong>state intervention<\/strong> in the matter is only the <strong>second-best option<\/strong>. The idea of liberalism is that the state should be neutral to moral concerns about institutions like marriage.<\/p>\n<h2><strong>What is the basis of an equality based and privacy-based approach for deciding same sex marriages?<\/strong><\/h2>\n<p>Citizens who see and value marriage as a <strong>heterosexual institution<\/strong> would be asked to recognise <strong>same-sex marriages<\/strong>, not as a matter of shared understanding but as a <strong>duty we owe to strangers.<\/strong><\/p>\n<p>If the matter were to be decided based on <strong>\u201cintrinsic value or social importance of the practice\u201d<\/strong>, one avoids the <strong>alienation<\/strong> that gives rise to f<strong>undamentalist tendencies.<\/strong><\/p>\n<h2><strong>What is the best way forward to decide about same-sex marriages?<\/strong><\/h2>\n<p>Compared<strong> to liberal court decisions imposed on a reluctant public, ultimately <\/strong>sustainable decisions were forced on parties and electoral assemblies by <strong>ad hoc citizens\u2019 assemblies in Ireland and the pressure of citizens\u2019 initiatives in Finland.<\/strong><\/p>\n<p>Ideally these questions should be <strong>left for citizens\u2019 assemblies or citizens\u2019 initiatives<\/strong> like in Ireland or Finland. In India, there is a need to look for equivalents.
