{"id":249808,"date":"2023-06-27T20:32:10","date_gmt":"2023-06-27T15:02:10","guid":{"rendered":"https:\/\/blog.forumias.com\/?p=249808"},"modified":"2023-08-31T16:21:19","modified_gmt":"2023-08-31T10:51:19","slug":"laying-the-foundation-for-a-future-ready-digital-india","status":"publish","type":"post","link":"https:\/\/forumias.com\/blog\/laying-the-foundation-for-a-future-ready-digital-india\/","title":{"rendered":"Laying the foundation for a future-ready digital India"},"content":{"rendered":"\n<p><strong>Source<\/strong>&#8211; The post is based on the article <strong>\u201cLaying the foundation for a future-ready digital India\u201d <\/strong>published in <strong>The<\/strong><strong> Hindu<\/strong><strong>\u00a0 <\/strong>on <strong>2<\/strong><strong>7<\/strong><strong>th June 2023<\/strong>.<\/p>\n<p><strong>Syllabus: <\/strong>GS2- Government policies and issues arising out of implementation<\/p>\n<p><strong>Relevance: <\/strong>Issues regarding Digital Technologies<\/p>\n<p><strong>News- <\/strong>.The Ministry of Electronics and IT has been actively organising consultations on the proposed \u201cDigital India Bill\u201d to build conceptual alignment on a new law that will replace India\u2019s 23-year-old Information Technology (IT) Act.<\/p>\n<h2><strong>What are the issues in the present IT Act?<\/strong><\/h2>\n<p>The definition of <strong>Social Media Intermediaries\u201d (SMIs) is so broad<\/strong> that it can encompass a variety of services such as video communications, matrimonial websites, email and even online comment sections on websites.<\/p>\n<p>The rules also lay down<strong> stringent obligations for most intermediaries<\/strong>, such as a <strong>72-hour timeline <\/strong>for responding to law enforcement asks.<\/p>\n<p>By virtue of being licensed, intermediaries are treated like<strong> conventional social media platforms <\/strong>not only <strong>adds to their cost of doing business<\/strong> but also exposes them to greater liability without meaningfully reducing risks presented by the Internet.<\/p>\n<p><strong>The European Union\u2019s Digital Services Act <\/strong>is probably one of the most developed frameworks for us to follow.<\/p>\n<h2><strong>What are <\/strong><strong>Focus areas for India<\/strong><strong>?<\/strong><\/h2>\n<p>What we need, is a <strong>classification framework<\/strong> that creates a <strong>few defined categories<\/strong>, requires intermediaries to <strong>undertake risk assessments<\/strong> and uses that information to bucket them into relevant categories.<\/p>\n<p>One way to do this would be to <strong>exempt micro and small enterprises<\/strong>, and caching and conduit services from any major obligations.<\/p>\n<p>Another way is to clearly<strong> distinguish communication services<\/strong> (where end-users interact with each other) from <strong>other forms of intermediaries <\/strong>(such as search engines and online-marketplaces).<\/p>\n<p><strong>Alternative approaches<\/strong> to curbing virality, such as <strong>circuit breakers to slow down content,<\/strong> could also be considered.<\/p>\n<p><strong>M<\/strong><strong>etrics for risk assessment and appropriate thresholds<\/strong> could help create a regulatory environment that helps achieve the government\u2019s <strong>policy goal of creating a safer Internet ecosystem<\/strong>, while also allowing businesses to thrive.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Source&#8211; The post is based on the article \u201cLaying the foundation for a future-ready digital India\u201d published in The Hindu\u00a0 on 27th June 2023.
