GS2- Government policies and interventions<\/p>\n<p><strong>Relevance:<\/strong> Issues related to regulation of data<\/p>\n<p><strong>News-<\/strong>. The Union Cabinet recently approved the d<a href=\"https:\/\/forumias.com\/blog\/data-protection-bill-approved-by-cabinet-content-concerns\/\">raft Data Protection Bill<\/a>.<\/p>\n<h2><strong>What are the issues with the draft data protection Bill?<\/strong><\/h2>\n<p>It appears the objective of the bill is to facilitate <strong>data collection and processing<\/strong> by the government and private entities rather than addressing the c<strong>oncerns for data protection<\/strong>.<\/p>\n<p>SC has recognised privacy as a <strong>fundamental right<\/strong> of citizens. It has emphasised the importance of <strong>informational self-determination and contro<\/strong>l for protecting the <strong>privacy and freedom<\/strong> of individuals. To ensure these protections, the SC established the standards of determination through three criteria: <strong>legality, legitimacy, and proportionality. <\/strong><\/p>\n<p><strong>Legality<\/strong>&#8211; Legality entails the existence of <strong>appropriate laws<\/strong>, particularly for significant <strong>government digital applications like digital surveillance<\/strong>.<\/p>\n<p>However, the current Bill seems contradictory.\u00a0 <strong>Section 5 of the latest draft <\/strong>implies that the proposed Act would permit any purpose <strong>unless explicitly prohibited by law.<\/strong><\/p>\n<p><strong>Legitimacy and proportionality<\/strong>&#8211; Legitimacy is related to the <strong>obligation of the state<\/strong> to convey that<strong> proposed digitalization<\/strong> involves a <strong>valid interest.<\/strong> Digital application should meet the <strong>test of proportionality. <\/strong><\/p>\n<p>There should be a careful balance between the extent to which<strong> Fundamental Rights<\/strong> might be affected. But there are currently no <strong>established standards<\/strong> for either of these tests.<\/p>\n<p>Legitimacy is disregarded. There is a lack of clear standards for <strong>determining proportionality<\/strong>. The draft bill contains the provisions to make <strong>&#8220;reasonable efforts&#8221;<\/strong> and implement <strong>&#8220;appropriate technical and organisational measures&#8221;. <\/strong><\/p>\n<p>These are insufficient measures for assessing the <strong>intrusive nature of the digital application<\/strong> and effectively <strong>balances risks. <\/strong><\/p>\n<p><strong>Consent provision<\/strong>&#8211; Draft Bill seems to have heavy<strong> reliance on consent<\/strong>. Individuals need to have an accurate understanding of all the <strong>privacy risks<\/strong> associated with <strong>complex digital applications. <\/strong><\/p>\n<p>In pervasive applications, denying consent may<strong> limit options, create hardships, or impede freedom of expression. <\/strong><\/p>\n<h2><strong>What are the suggestions for improvement in the draft data protection Bill?<\/strong><\/h2>\n<p><strong>Specific guidelines and criteria <\/strong>are necessary for <strong>conducting risk assessments and determining legitimacy<\/strong>. These standards cannot be developed without <strong>well-defined guidelines and regulations.<\/strong><\/p>\n<p>It should acknowledge the <strong>privacy risks associated with digital applications. <\/strong><\/p>\n<p>There are not only the risks of <strong>illegal surveillance, profiling, and unauthorised exposure<\/strong> of private information. There are also <strong>indirect harms <\/strong>when data elements are linked together to create <strong>distorted digital representations. <\/strong><\/p>\n<p>The measures of <strong>post-violation complaints and penalties<\/strong> are not adequate for protection. Protection from indirect harms needs to be<strong> ex-ante rather than ex-post.\u00a0 <\/strong><\/p>\n<p><strong>Data fiduciaries and data controllers<\/strong> need to have standards for <strong>ex-ante privacy protection and purpose limitation.<\/strong><\/p>\n<p>Effective data protection necessitates an <strong>accountability-based framework<\/strong> rather than one <strong>solely based on consent.<\/strong> This framework places the responsibility on d<strong>ata controllers and fiduciaries<\/strong>, regardless of the <strong>level of consent<\/strong>, rather than <strong>solely on individuals. <\/strong><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Source&#8211; The post is based on the article \u201cData protection Bill: Hiding behind consent\u201d published in \u201cThe Indian Express\u201d on 14th July 2023.
