Governments shouldn\u2019t be exempted from it<\/strong>\u201d published in \u201cTimes of India\u201d on 21st July 2023.<\/p>\n<p><strong>Syllabus:<\/strong> GS 2 &#8211; dispute redressal mechanisms and institutions<\/p>\n<p><strong>News:<\/strong> The Mediation Bill was cleared by the Union cabinet this week for introduction in the just-started monsoon session of Parliament.<\/p>\n<h2><strong>What is mediation Bill?<\/strong><\/h2>\n<p>Mediation Bill was introduced to address the backlog of over 45 million cases in India&#8217;s judicial system, where 90% are in district and subordinate courts.<\/p>\n<h2><strong>Features of Mediation Bill<\/strong><\/h2>\n<p><strong>Nature:<\/strong> Non-adversarial, consent-based.<\/p>\n<p><strong>Scope:<\/strong> Limited to civil and commercial disputes.<\/p>\n<p><strong>Procedure:<\/strong> Mandatory two-session pre-litigation mediation.If it\u2019s unsatisfactory, a disputant can opt out and switch to litigation.<\/p>\n<p><strong>Duration:<\/strong> Maximum 180 days, extendable by another 180 days.<\/p>\n<p><strong>Outcome:<\/strong> Mediation agreement is binding on all involved parties.<\/p>\n<h2><strong>What are the major concerns related to Mediation Bill?<\/strong><\/h2>\n<p><strong>Mandatory Mediation:<\/strong> The Mediation Bill requires mandatory mediation before litigation. There&#8217;s concern this can be misused to purposely delay cases.
