It should avoid the tendency to keep someone in prison solely based on s<strong>trong opposition <\/strong>from the police.<\/p>\n<p>The Supreme Court of India rejected the Gujarat police&#8217;s argument that the <strong>alleged seriousness of the offence<\/strong> justified denying her bail.<\/p>\n<p>The case relies primarily on <strong>documentary evidence<\/strong>, all of which is already included in the charge sheet. So, the Court has no reason to keep her in <strong>judicial custody.<\/strong><\/p>\n<h2><strong>What is the importance of the verdict?<\/strong><\/h2>\n<p>The verdict reminded us that an <strong>order of bail must be the norm<\/strong>. The factors which must be taken into account are- (a) Likelihood of the accused f<strong>leeing justice or being available for trial<\/strong>. (b) <strong>Influencing witnesses or tampering with evidence<\/strong>.<\/p>\n<p><strong>Seriousness of the offence<\/strong> is an important aspect.
