{"id":254781,"date":"2023-08-04T19:16:45","date_gmt":"2023-08-04T13:46:45","guid":{"rendered":"https:\/\/blog.forumias.com\/?p=254781"},"modified":"2023-08-04T19:16:45","modified_gmt":"2023-08-04T13:46:45","slug":"rajya-sabha-passes-mediation-bill-2021","status":"publish","type":"post","link":"https:\/\/forumias.com\/blog\/rajya-sabha-passes-mediation-bill-2021\/","title":{"rendered":"Rajya Sabha passes Mediation Bill, 2021"},"content":{"rendered":"\n<p><b>Source: <\/b><span style=\"font-weight: 400;\">The post is based on the article<\/span><b> \u201cRajya Sabha passes Mediation Bill, 2021<\/b><b>\u201d\u00a0 <\/b><span style=\"font-weight: 400;\">published in <\/span><b>The Economic Times on 1st August 2023.<\/b><\/p>\n<h2><b>What is the News?<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Rajya Sabha has passed the Mediation Bill 2021.<\/span><\/p>\n<h2><b>What is Mediation?<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Mediation is a type of ADR (alternative dispute resolution), where a dispute is referred to a neutral person, who engages with the warring parties and tries to find a solution agreeable to both.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Courts have regularly been ordering mediation to settle civil, commercial, and family disputes among others.<\/span><\/p>\n<h2><b>What are the key provisions of the Mediation Bill 2021?<\/b><\/h2>\n<p><b>Firstly, <\/b><span style=\"font-weight: 400;\">persons can try to settle civil or commercial disputes through mediation before approaching any court or tribunal. However, the pre-litigation mediation is voluntary and not mandatory.<\/span><\/p>\n<p><b>Secondly, <\/b><span style=\"font-weight: 400;\">a party may withdraw from mediation after two mediation sessions.\u00a0<\/span><\/p>\n<p><b>Thirdly,<\/b><span style=\"font-weight: 400;\"> the mediation process must be completed within 180 days, which may be extended by another 180 days by the parties.<\/span><\/p>\n<p><b>Fourthly, <\/b><span style=\"font-weight: 400;\">the Mediation Council of India will be set up. Its functions include registering mediators, and recognising mediation service providers and mediation institutes (which train and certify mediators).<\/span><\/p>\n<p><b>Fifthly, <\/b><span style=\"font-weight: 400;\">currently, mediations are ordered by the courts and when a dispute is thus settled, the settlement agreement is converted into a decree by the court, thus making it binding on the parties. However, the Mediation bill puts a mediated settlement agreement on par with a court judgment without the need for any further court sanction.<\/span><\/p>\n<p><b>Lastly<\/b><span style=\"font-weight: 400;\">, Mediation agreements can only be challenged on grounds of: (i) fraud, (ii) corruption, (iii) impersonation, or (iv) relating to disputes not fit for mediation.\u00a0<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Source: The post is based on the article \u201cRajya Sabha passes Mediation Bill, 2021\u201d\u00a0 published in The Economic Times on 1st August 2023.
