It can be done only after obtaining the <strong>data principal&#8217;s consent.<\/strong> It can be processed for<strong> specific legitimate reasons. <\/strong><\/p>\n<p>These legitimate reasons are instances in which the data can be processed without obtaining the <strong>data principal&#8217;s consent.<\/strong> This includes situations where government agencies <strong>process the data <\/strong>to issue licenses, provide welfare benefits, grants, and services.<\/p>\n<p>The Bill also imposes a <strong>responsibility on the data fiduciary<\/strong> to inform both the <strong>data principal and the Data Protection Board<\/strong> to assess compliance with the Bill in case of a <strong>breach of personal data.<\/strong><\/p>\n<h2><strong>What are the concerns related to the Bill?<\/strong><\/h2>\n<p>The Bill does not contain the provision related to the requirement of <strong>informing data principals <\/strong>about third parties with whom their data might be shared, or specifying the duration for which the data will be stored.<\/p>\n<p>Too much leeway is provided to agencies of the state in the <strong>form of exemptions. <\/strong><\/p>\n<p>The <strong>Srikrishna Committee\u2019s Draft Bill in 2018<\/strong> allowed for<strong> exemptions <\/strong>to state institutions from acquiring informed consent in matters related only to the <strong>\u201csecurity of the state\u201d.<\/strong><\/p>\n<p>It also suggested<strong> parliamentary oversight and judicial approval<\/strong> of non-consensual access to personal data.<\/p>\n<p>In the 2023 version, the state is empowered to process data through<strong> wide-ranging exemptions<\/strong>.
