It has transformed the <strong>pre-litigation mediation<\/strong> from <strong>obligatory to voluntary<\/strong>. It was also highly necessary, considering that <strong>voluntariness<\/strong> constitutes an <strong>essential principle of mediation.<\/strong><\/p>\n<p>The support for the <strong>validation and implementation<\/strong> of settlement agreements stemming from mediation is the right step. It aligns seamlessly with the <strong>United Nations Convention on International Settlement Agreements Resulting from Mediation.<\/strong><\/p>\n<h2><strong>What are the concerning aspects of the Bill?<\/strong><\/h2>\n<p>There are limited grounds listed in the Bill to challenge the<strong> enforcement of a settlement agreement<\/strong> and a <strong>period of 90 days<\/strong> is given to raise the challenge. It needs a relook.<\/p>\n<p>A settlement agreement is essentially a contract between the parties. Sometimes, <strong>grounds for challenging <\/strong>are detected at a later stage.<\/p>\n<p>There are also some <strong>technical flaws<\/strong>. <strong>Clause 8 of the Bill<\/strong> entitles a party to move the Court, before the commencement or during mediation, for interim relief, only in <strong>\u201cexceptional circumstances\u201d. <\/strong><\/p>\n<p>The phrase &#8220;<strong>exceptional circumstances&#8221; <\/strong>is <strong>lacking in definition<\/strong> within the Bill. It also deviates from the established norms of seeking <strong>interim relief in civil courts.<\/strong><\/p>\n<p>Moreover, there is no<strong> remedy of appeal<\/strong> available against an order passed under this proposed section. Even our<strong> arbitration regime<\/strong> provides an <strong>appellate recourse.<\/strong><\/p>\n<p>The Bill introduces the concepts of<strong> \u201conline\u201d and \u201ccommunity\u201d mediation.<\/strong> A recent<strong> Niti Aayog report <\/strong>reveals that only 55% of India have <strong>access to the internet<\/strong> and only 27% possess compatible devices.<\/p>\n<p>As for <strong>community mediation<\/strong>, the Bill makes it mandatory to have a <strong>panel of three mediators. <\/strong>This requirement is <strong>unnecessary<\/strong> and impacts the <strong>flexibility<\/strong> that mediation brings.<\/p>\n<p>Government is the<strong> biggest litigant<\/strong> in the country. Limiting the government&#8217;s willingness to engage in mediation processes solely to <strong>&#8220;commercial disputes<\/strong>&#8221; contradicts the intent behind the legislation.<\/p>\n<p><strong>Way forward- <\/strong><\/p>\n<p>The standing committee has recommended that government-related disputes be included in the Bill. The Bill provided a golden opportunity to the government to change that perception.<\/p>\n<p>This will inspire c<strong>onfidence amongst all stakeholders<\/strong> and help in reducing the <strong>pendency of backlog.<\/strong><\/p>\n<p>Mediation should be promoted as a <strong>preferred and voluntary mode<\/strong> of securing justice. The Bill is <strong>prescriptive<\/strong>.The regular individual will now need <strong>additional guidance and support<\/strong> to attain justice.<\/p>\n<p>For online mediation, there is a need to scale the <strong>bandwidth accessibility<\/strong> to remote parts of the country.
