{"id":259084,"date":"2023-09-07T19:42:44","date_gmt":"2023-09-07T14:12:44","guid":{"rendered":"https:\/\/blog.forumias.com\/?p=259084"},"modified":"2023-10-08T12:28:41","modified_gmt":"2023-10-08T06:58:41","slug":"explained-the-global-push-to-make-ecocide-a-crime","status":"publish","type":"post","link":"https:\/\/forumias.com\/blog\/explained-the-global-push-to-make-ecocide-a-crime\/","title":{"rendered":"Explained | The global push to make ecocide a crime"},"content":{"rendered":"\n<p><b>Source: <\/b><span style=\"font-weight: 400;\">The post is based on the article <\/span><b>\u201cExplained | The global push to make ecocide a crime\u201d<\/b><span style=\"font-weight: 400;\"> published in <\/span><b>The Hindu on 7th September 2023<\/b><\/p>\n<h2><b>What is the News?<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Mexico is considering passing a law to make ecocide a crime.<\/span><\/p>\n<h2><b>What is Ecocide?<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Ecocide is derived from Greek and Latin.It translates to \u2018killing one\u2019s home\u2019 or \u2018environment\u2019.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Such \u2018killing\u2019 could include port expansion projects that destroy fragile marine life and local livelihoods; deforestation; illegal sand mining; polluting rivers with untreated sewage.<\/span><\/p>\n<p><b>Legal Definition of ecocide: <\/b><span style=\"font-weight: 400;\">There is no accepted legal definition of ecocide, but a Stop Ecocide Foundation in 2021 prepared a definition of ecocide.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u2013 It has defined Ecocide as the unlawful or wanton acts committed with knowledge that there is a substantial likelihood of severe and either widespread or long-term damage to the environment being caused by those acts.<\/span><\/p>\n<p><b>Commonly cited examples of ecocide include: <\/b><span style=\"font-weight: 400;\">deforestation during the Vietnam War, the destruction of the environment during the Russian invasion of Ukraine, deforestation in Indonesia and the Amazon rainforest, oil pollution in the Niger Delta and the Chernobyl disaster.\u00a0<\/span><\/p>\n<p><b>The term \u2018ecocide\u2019 was popularized b<\/b><span style=\"font-weight: 400;\">y Olof Palme when he accused the United States of ecocide at the 1972 UN Conference on the Human Environment.<\/span><\/p>\n<h2><b>Is ecocide covered under International Law? <\/b><\/h2>\n<p><span style=\"font-weight: 400;\">At present, the Rome Statute of the International Criminal Court (ICC) deals with four atrocities: genocide, crimes against humanity, war crimes and the crime of aggression.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u2013 The provision on war crimes is the only statute that can hold a perpetrator responsible for environmental damage albeit if it is intentionally caused and <\/span><b>during wartime situations.<\/b><\/p>\n<h2><b>Why should ecocide be criminalized?<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Over a third of the earth\u2019s animal and plant species could be extinct by 2050. Unprecedented heat waves have broken records worldwide. Changing rainfall schemes have disrupted flood and drought patterns.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Deforestation of the Amazon, deep-sea trawling or even the catastrophic 1984 Bhopal gas disaster could have been avoided with ecocide laws in place.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Ecocide laws could also double up as calls for justice for low- and middle-income countries disproportionately affected by climate change.<\/span><\/p>\n<h2><b>Which countries have criminalized ecocide?<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Ecocide is a crime in 11 countries, with 27 other nations mulling laws around criminalizing environmental damage that is wilfully caused and harms humans, animals and plant species.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The European Parliament voted unanimously this year to enshrine ecocide in law.<\/span><\/p>\n<h2><b>What has been India\u2019s stance on ecocide?<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Some Indian judgments have used the term \u2018ecocide\u2019 in passing, but the<\/span><b> concept hasn\u2019t fully materialized in law.<\/b><\/p>\n<p><b>\u2013 In Chandra CFS and Terminal Operators Pvt. Ltd. v. The Commissioner of Customs and Ors (2015), <\/b><span style=\"font-weight: 400;\">the Madras High Court noted: the prohibitory activities of ecocide have been continuing unbridledly by certain sections of people by removing the valuable and precious timbers.<\/span><\/p>\n<p><b>\u2013 In an ongoing case, T.N. Godavarman Thirumulpad vs Union of India &amp; Ors,<\/b><span style=\"font-weight: 400;\"> the Supreme Court called attention to an \u201canthropogenic bias\u201d and argued that \u201cenvironmental justice could be achieved only if we drift away from the principle of anthropocentric to ecocentric\u201d.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Hence, there is a need for India to align the existing environmental legislations with the concept of ecocide.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">One more critical challenge is to tackle problems of liability and compensation.For instance, the survivors of Bhopal gas tragedy<\/span> <span style=\"font-weight: 400;\">are still fighting for compensation.<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Source: The post is based on the article \u201cExplained | The global push to make ecocide a crime\u201d published in The Hindu on 7th September 2023 What is the News?
