{"id":259640,"date":"2023-09-12T19:33:35","date_gmt":"2023-09-12T14:03:35","guid":{"rendered":"https:\/\/blog.forumias.com\/?p=259640"},"modified":"2023-10-08T08:44:13","modified_gmt":"2023-10-08T03:14:13","slug":"cbi-does-not-require-permission-to-probe-pre-2014-cases-too-sc","status":"publish","type":"post","link":"https:\/\/forumias.com\/blog\/cbi-does-not-require-permission-to-probe-pre-2014-cases-too-sc\/","title":{"rendered":"CBI does not require permission to probe pre-2014 cases too: SC"},"content":{"rendered":"\n<p><b>Source: <\/b><span style=\"font-weight: 400;\">The post is based on the article<\/span><b> \u201cCBI does not require permission to probe pre-2014 cases too: SC\u201d <\/b><span style=\"font-weight: 400;\">\u00a0published in <\/span><b>The Hindu on 12th September 2023<\/b><\/p>\n<h2><b>What is the News?<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">A Constitution Bench held that a Supreme Court judgment of 2014 which declared Section 6A of the Delhi Special Police Establishment (DSPE) Act invalid has a retrospective effect.<\/span><\/p>\n<h2><b>What is Section 6A of the Delhi Special Police Establishment (DSPE) Act?<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Section 6A of the DSPE Act was added in 2003 through Section 26 of the Central Vigilance Commission Act(CVCA).<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The section mandated the government\u2019s prior sanction to proceed in corruption cases against officers of the rank of joint secretary and above.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">However, an exception provided in Section 6A(2) states that no approval is necessary for cases involving arrest of a person on the spot on the charge of accepting or attempting to accept a bribe.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In 2014, a five-judge Constitution Bench struck down Section 6A of the DSPE Act, ruling that status or position cannot shield an officer of the level of joint secretary and above from an unconstrained probe by the CBI in cases of corruption.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">This court termed Section 6A a \u201cdiscriminatory\u201d provision that \u201cimpedes tracking down the corrupt senior bureaucrats\u201d.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">But the 2014 ruling <\/span><span style=\"font-weight: 400;\">did not clarify what would happen to existing cases being probed by the CBI\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Therefore, a constitution bench was constituted to examine whether the 2014 decision would affect existing corruption cases.<\/span><\/p>\n<h2><b>What did the Constitution Bench of the Supreme Court rule?<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">The main question before the constitution bench was <\/span><span style=\"font-weight: 400;\">related to the applicability of Section 6A in DSPE Act.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The constitution bench held that the Supreme Court\u2019s 2014 ruling which struck down Section 6A of the DSPE Act will apply retrospectively.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">This means that there would be no protection to the public servants on the premise of a sanction under Section 6A in pre-2014 cases.<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Source: The post is based on the article \u201cCBI does not require permission to probe pre-2014 cases too: SC\u201d \u00a0published in The Hindu on 12th September 2023 What is the News?
