{"id":263215,"date":"2023-10-07T18:42:23","date_gmt":"2023-10-07T13:12:23","guid":{"rendered":"https:\/\/blog.forumias.com\/?p=263215"},"modified":"2023-10-07T20:08:40","modified_gmt":"2023-10-07T14:38:40","slug":"heres-why-ex-servicemen-are-against-the-entitlement-rules-for-award-of-disability-compensation-for-military-personnel","status":"publish","type":"post","link":"https:\/\/forumias.com\/blog\/heres-why-ex-servicemen-are-against-the-entitlement-rules-for-award-of-disability-compensation-for-military-personnel\/","title":{"rendered":"Here\u2019s why ex-servicemen are against the entitlement rules for award of disability compensation for military personnel"},"content":{"rendered":"\n<p><b>Source: <\/b><span style=\"font-weight: 400;\">The post is based on the article<\/span><b> \u201cHere\u2019s why ex-servicemen are against the entitlement rules for award of disability compensation for military personnel\u201d <\/b><span style=\"font-weight: 400;\">published in <\/span><b>\u201cIndian Express\u201d on 7th October 2023<\/b><\/p>\n<h2><b>What is the News?<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Government <\/span><span style=\"font-weight: 400;\">has announced several changes in the disability pension rules of the armed forces.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The new guidelines are called \u201cEntitlement Rules of Casualty Pension and Disability Compensation Award to Armed Forces Personnel 2023\u201d.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The new guidelines <\/span><span style=\"font-weight: 400;\">will be applicable to personnel who retire after September 21,2023.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">However, the <\/span><span style=\"font-weight: 400;\">All India Ex-Servicemen Welfare Association has reportedly objected to the changes.<\/span><\/p>\n<h2><b>What are the key concerns raised by ex-servicemen related to the new <\/b><b>disability pension rules of the armed forces?<\/b><\/h2>\n<p><b>Removal of &#8216;Benefit of Doubt&#8217; Clause: <\/b><span style=\"font-weight: 400;\">The <\/span><span style=\"font-weight: 400;\">most important existing rule was that military personnel shall not be called upon to prove their entitlement and the \u2018benefit of reasonable doubt\u2019 will be given to the claimant.This rule has now been abrogated in the new rules.\u00a0<\/span><\/p>\n<p><b>Positive Presumption Clause Abrogated:<\/b><span style=\"font-weight: 400;\"> The new rules state that the mere manifestation of a disease during military service does not mean it&#8217;s attributable to service, which is contrary to the previous rules and global military practices.<\/span><\/p>\n<p><b>Changes attributable to \u2018military service rule\u2019: <\/b><span style=\"font-weight: 400;\">In new rules, it has been stated that diseases will only be considered attributable to service in case they occur in active operations, high altitude, extreme physical exertion etc.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u2013 In the earlier rules, the place of deployment was not a condition for the grant of benefits.<\/span><\/p>\n<p><b>Changes in Service Conditions: <\/b><span style=\"font-weight: 400;\">The new rules provide that heart diseases etc would only be treated as connected with service in case the same occurs after a service of more than three months in active operations, high altitude areas and extreme physical exertion for more than 72 hours continuously.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u2013 The earlier rules simply stated that such disabilities are all affected by stress and strain of military service.<\/span><\/p>\n<p><b>Changes in \u2018aggravation by service\u2019: <\/b><span style=\"font-weight: 400;\">In new rules, aggravation by service has been linked to only extreme climatic conditions, field operations, high altitude etc.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u2013 The old rule provided that in case of worsening of any disability persisting at the time of discharge, the disability would be treated as aggravated by service thereby resulting in grant of disability pension.<\/span><\/p>\n<p><b>Diseases Removed from List: <\/b><span style=\"font-weight: 400;\">Under the old rules, all cancers except those caused by smoking were deemed to be aggravated by service in case of worsening during military service.But now all cancers have been taken out of the list and only those caused by radiation or exposure to chemicals during service will be included in the attributable list.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u2013 Moreover, all types of diabetes have also been excluded from the attributable\/aggravation list.<\/span><\/p>\n<p><b>Impairment Relief Clause: <\/b><span style=\"font-weight: 400;\">The definition of Disability Pension\/Disability Element of Pension for those who retire on superannuation or are discharged from service or discharged voluntarily has been changed to \u2018Impairment Relief\u2019 so that it is taken out of the tax exemption regime wherein \u2018disability element and service element of disability pension\u2019 are exempted from Income Tax.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u2013 A similar step has been taken for the war injury element\/pension by changing its name to \u201cWar Injury Relief\u201d.<\/span><\/p>\n<p><b>Psychiatric Disorders Clause: <\/b><span style=\"font-weight: 400;\">The new rules link psychiatric\/ behavioral disorders with only combat areas, three-month continuous service in high altitude etc as if military service or being away from family or inability to cope with domestic issues due to military service has no link with psychiatric disorders.<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Source: The post is based on the article \u201cHere\u2019s why ex-servicemen are against the entitlement rules for award of disability compensation for military personnel\u201d published in \u201cIndian Express\u201d on 7th October 2023 What is the News?
