News<\/strong>:\u00a0This article discusses the importance of defining \u201cterrorism\u201d.<\/p>\n

How was violence categorized in India by the NCRB?<\/strong><\/h2>\n

National Crime Records Bureau (NCRB) Reports between 2004 and 2019 had a chapter on \u201cviolent crimes\u201d. This chapter was subcategorised into violent crimes affecting the body \u2014 murder, kidnapping, etc., violent crimes affecting public safety \u2014 riot, arson, and violent crimes affecting property.<\/p>\n

The chapter also mentions \u201cmotives behind violent crimes\u201d and identifies \u201cpersonal vendetta\u201d along with reasons like \u201ccaste conflicts\u201d, \u201ccommunalism\u201d, and \u201cterrorist and other extremist violence\u201d.<\/p>\n

Communal, caste and class-motivated violence were grouped together, and, thus, hierarchically the same as \u201cterrorist or extremist\u201d violence.<\/p>\n

What changes in the categorization of violence have been brought in recently?<\/strong><\/h2>\n

Now, caste, class and communal violence are now reflected in the section on \u201cmurder\u201d. Whereas \u201cterrorist and extremist\u201d offences have got a chapter of their own titled \u201coffences against the state\u201d.<\/p>\n

It includes acts<\/strong> ranging from \u201csedition\u201d to crimes relating to damage to public property, and, finally, crimes under the Unlawful Activities Prevention Act and the Official Secrets Act.<\/p>\n

There is also a new chapter on \u201ccrimes by \u201canti-national\u201d elements, which enumerates ordinary offences by \u201canti-nationals\u201d, \u201cNorth-East insurgents\u201d, \u201cNaxalites and left-wing extremists\u201d and \u201cterrorists including Jihadi terrorists\u201d.<\/p>\n

This has 2 implications:<\/strong><\/p>\n

1) It distinguishes \u201cterrorism\u201d from other violent crimes.<\/p>\n

2) It implies that such acts are those that are solely directed against the state\/government and form a continuum from dissenting speech to physical violence.<\/p>\n

What is the internationally recognized classification?<\/strong><\/h2>\n

International humanitarian law recognises \u201cwar crimes\u201d as a legal category.<\/p>\n

However, \u201cterrorism\u201d is not universally defined in customary international law.<\/strong> Violent events being categorised as \u201cterrorist\u201d is more a political than a legal act.<\/p>\n

As evident by the domestic and international scenario, and in the wake of the recent events in Gaza, it is evident that there should be more public debate on the shifting meanings of \u201cterrorism\u201d.<\/p>\n
