News<\/strong>:\u00a0This article discusses the issues with the Electoral Bonds scheme in light of the ongoing proceedings in the Supreme Court regarding its validity. It also suggests reforms to tackle the issue of a lack of transparency in political funding.<\/p>\n

Recently, a Constitutional Bench of the Supreme Court has taken up petitions challenging the electoral bonds scheme.<\/p>\n

The proceedings focused on arguments pertaining to the voters\u2019 right to information<\/strong> and the right to confidentiality of donors.<\/strong><\/p>\n

What is the citizen\u2019s \u2018Right to Know\u2019?<\/strong><\/h2>\n

The citizens\u2019 right to know<\/strong> was established by the Supreme Court rulings in the People\u2019s Union for Civil Liberties case, 2003 <\/strong>and in the Association for Democratic Reforms<\/strong> case, 2002<\/strong>.<\/p>\n

The Court ruled that the right to know<\/strong> about public officials is derived from the right to freedom of expression. <\/strong><\/p>\n

The Court mandated the Election Commission to disclose information related to candidates<\/strong> running for office, to the public.<\/p>\n

This information included information on their assets<\/strong>, criminal records<\/strong>, and educational background<\/strong>.<\/p>\n

What is the stand of the government on the citizen\u2019s \u2018Right to Know\u2019?<\/strong><\/h2>\n

The Attorney General<\/strong> has told the Supreme Court, in the written submissions, that the \u201ccitizens\u2019 right to know is subject to reasonable restrictions<\/strong>\u201d.<\/p>\n

The argument put forward by the Solicitor General<\/strong> is that citizens have no right to know<\/strong> the donors\/recipients\u2019 identities.<\/p>\n

As per the author, this statement doesn\u2019t suit the world\u2019s largest democracy.<\/p>\n

What should be the way forward?<\/strong><\/h2>\n

1) Disclosing the identities of donors and recipients.<\/strong><\/p>\n

2) Eliminate private funding and introduce public funding for political parties.<\/strong> It\u2019s a small investment for the preservation of democracy (estimated at around Rs. 10,000 crore every 5 years).<\/p>\n

3) Establishing a National Election Fund<\/strong> to which all donors could contribute<\/strong>. The funds could be allocated to parties based on their electoral performance.<\/p>\n
