State of Punjab, 1980<\/strong>, the Supreme Court of India upheld the constitutionality of the death penalty in India but laid down the <strong>&#8216;rarest of rare&#8217; doctrine<\/strong>. It requires judges to impose the punishment only in the &#8216;rarest of rare&#8217; cases.<\/p>\n<h2><strong>What are the arguments for abolishing the Death Penalty?<\/strong><\/h2>\n<ol>\n<li><strong>Does not deter crime: <\/strong>There is no conclusive evidence that the death penalty deters crime more effectively than long prison sentences.<\/li>\n<li><strong>Takes away the scope for reform: <\/strong>Imprisonment for the remainder of the convict\u2019s natural life will be a more rigorous punishment and provide scope for reform.<\/li>\n<li><strong>Disproportionately affects the underprivileged: <\/strong>Most of those on death row came from underprivileged backgrounds. Nearly 3\/4<sup>th<\/sup> of death row prisoners are from Lower Castes or Religious Minorities.<\/li>\n<li><strong>Global opinion in favour of its abolition:<\/strong> There are 98 countries which have abolished it for all crimes.<\/li>\n<\/ol>\n<h2><strong>What should be done?<\/strong><\/h2>\n<ol>\n<li><strong>Devising a Remission Policy: <\/strong>Removing capital punishment and introducing a universal <strong>remission policy<\/strong> will be important. In <strong>remission<\/strong>, the duration of the sentence is reduced without changing the nature of the sentence.<\/li>\n<li><strong>Life Imprisonment as an alternative: <\/strong>\u2018Life imprisonment\u2019 (term for the remainder of one\u2019s natural life) should be the default alternative to death sentences.<\/li>\n<\/ol>\n<p><strong>Question for practice:<\/strong><\/p>\n<p>Various arguments have been cited by experts for abolishing the death penalty in India.
