The judgement was based on a petition filed by the Punjab government against it&#8217;s Governor&#8217;s action to hold back crucial bills.<\/p>\n<table style=\"width: 100%; border-collapse: collapse; border-style: solid;\">\n<tbody>\n<tr>\n<td style=\"width: 100%;\">For more information on State of Punjab vs Governor issue and Supreme court observations, <a href=\"https:\/\/forumias.com\/blog\/governor-cannot-sit-on-bills-passed-by-state-legislature\/\" target=\"_blank\" rel=\"noopener\">Click Here to read<\/a><\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<h2>What are the Highlights of the Judgement?<\/h2>\n<p>1.<strong> Mandatory to return the bill for reconsideration if assent withheld<\/strong>&#8211; Court has held that under <strong>Article 200<\/strong>, if the Governor withholds assent he <strong>must return the bill &#8220;as soon as possible&#8221;<\/strong> with a message to reconsider the proposed law. A Governor who chooses to withhold a Bill without doing anything further would be acting in contravention of the Constitution.<\/p>\n<p>2. It said the expression \u201cas soon as possible\u201d conveyed a \u201c<strong>constitutional imperative of expedition<\/strong>\u201d which means<strong> cannot hold indefinitely<\/strong>. The court has thus clarified its position on &#8216;pocket veto&#8217;<\/p>\n<p>3. <strong>Governor enjoys no veto power over Bills- <\/strong>After returning the Bill for reconsideration, if the State legislature <strong>passes the Bill again,<\/strong><strong>\u00a0with or without amendment<\/strong> and the Bill is presented to the Governor for assent, the <strong>Governor shall not withhold assent<\/strong> (Article 200).<\/p>\n<p>4. <strong>Governor only a symbolic head<\/strong>; <strong>real power with elected representatives<\/strong>&#8211; The Court reaffirmed that the Governor is an unelected Head of the State and cannot use his constitutional powers to thwart the normal course of lawmaking by the State.<\/p>\n<p>5.
