{"id":271035,"date":"2023-11-25T20:19:51","date_gmt":"2023-11-25T14:49:51","guid":{"rendered":"https:\/\/forumias.com\/blog\/?p=271035"},"modified":"2023-11-25T20:19:51","modified_gmt":"2023-11-25T14:49:51","slug":"centre-exempts-cert-in-from-purview-of-rti-act","status":"publish","type":"post","link":"https:\/\/forumias.com\/blog\/centre-exempts-cert-in-from-purview-of-rti-act\/","title":{"rendered":"Centre exempts CERT-In from purview of RTI Act"},"content":{"rendered":"<p><strong>Source-<\/strong> This post is based on the article <strong>&#8220;Centre exempts CERT-In from purview of RTI Act<\/strong>&#8221; published in &#8220;<strong>The Hindu<\/strong>&#8221; on 24 November 2023.<\/p>\n<h2>Why in the News?<\/h2>\n<p>The Central government in its recent official order has exempted the Computer Emergency Response Team (CERT-In) from the ambit of the Right to Information (RTI) Act.<\/p>\n<h2>What is CERT-In?<\/h2>\n<table style=\"width: 100%; border-collapse: collapse; border-style: solid;\">\n<tbody>\n<tr>\n<td style=\"width: 29.2727%;\"><strong>What is it?<\/strong><\/td>\n<td style=\"width: 70.7273%;\">The CERT-In (Computer Emergency Response Team- India) is the <strong>national nodal agency for responding to computer security incidents or cyber security threats<\/strong> like hacking and phishing as and when they occur.<\/td>\n<\/tr>\n<tr>\n<td style=\"width: 29.2727%;\"><strong>Established in<\/strong><\/td>\n<td style=\"width: 70.7273%;\">CERT-IN was <strong>formed in 2004<\/strong> by the Government of India<strong> under Information Technology Act, 2000 Section (70B)<\/strong><\/td>\n<\/tr>\n<tr>\n<td style=\"width: 29.2727%;\"><strong>Nodal Ministry\u00a0<\/strong><\/td>\n<td style=\"width: 70.7273%;\">Ministry of Electronics and Information Technology (<strong>MeitY<\/strong>)<\/td>\n<\/tr>\n<tr>\n<td style=\"width: 29.2727%;\"><strong>Vision<\/strong><\/td>\n<td style=\"width: 70.7273%;\">Proactive contribution in securing India&#8217;s cyber space.<\/td>\n<\/tr>\n<tr>\n<td style=\"width: 29.2727%;\"><strong>Objective\u00a0<\/strong><\/td>\n<td style=\"width: 70.7273%;\">1.<strong> Preventing cyber attacks<\/strong> against the country&#8217;s cyber space.<br \/>\n2. <strong>Responding to cyber attacks and minimizing damage<\/strong> and recovery time, reducing &#8216;national vulnerability to cyber attacks.<br \/>\n&#8211; It was the first responder to the<strong> ransomware attack on November 23, 2022 at AIIMS <\/strong>which had crippled the \u201cHospital Information System (HIS) and e-Hospital\u201d system for several days.<br \/>\n3. Enhancing <strong>security awareness<\/strong> among citizens.<\/td>\n<\/tr>\n<tr>\n<td style=\"width: 29.2727%;\"><strong>Additional responsibility<\/strong><\/td>\n<td style=\"width: 70.7273%;\">It has<strong> overlapping responsibilities<\/strong> with other agencies such as <strong>National Critical Information Infrastructure Protection Centre (NCIIPC)<\/strong> which is under the National Technical Research Organisation (NTRO) of Prime Minister&#8217;s Office and the <strong>National Disaster Management Authority (NDMA),<\/strong> which is under Ministry of Home Affairs.<\/td>\n<\/tr>\n<tr>\n<td style=\"width: 29.2727%;\"><strong>Cyber Conventions<\/strong><\/td>\n<td style=\"width: 70.7273%;\"><strong>Budapest Convention on Cybercrime<\/strong>: It is the<strong> first international treaty <\/strong>that seeks to address Internet and cybercrime by harmonizing national laws. It came into force in 2004.<b> India is not a signatory to this convention<\/b><\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<table style=\"width: 100%; border-collapse: collapse; border-style: solid;\">\n<tbody>\n<tr>\n<td style=\"width: 100%;\"><strong>For more information on CERT-In and other cyber programmes<\/strong> <a href=\"https:\/\/forumias.com\/blog\/what-is-cert-in\/\" target=\"_blank\" rel=\"noopener\">click Here to read<\/a><\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<h2>Exemptions for Intelligence and Security Organisations from RTI Act<\/h2>\n<p>1. The RTI Act, enacted in 2005, states that the <strong>legislation shall not apply to intelligence and security organisations specified in the Second Schedule, &#8220;provided that the information pertaining to the allegations of corruption and human rights violations shall not be excluded.&#8221;<\/strong><\/p>\n<p>2. So far, there are <strong>26 intelligence and security organisations<\/strong> that are exempted from the RTI Act. This includes Intelligence Bureau, Research and Analysis Wing, Defence Research and Development Organisation, etc.<\/p>\n<p>3.
