Why in the News?<\/strong><\/h2>\n

The Union Home Minister has recently introduced <\/span>Bharatiya Sakshya (BS) Bill in the Lok Sabha along with Bharatiya Nyaya Sanhita Bill, 2023 and the Bharatiya Nagarik Suraksha Sanhita Bill, 2023.<\/span><\/p>\n

What is the Bharatiya Sakshya (BS) Bill?<\/strong><\/h2>\n

Aim:<\/b> To <\/span>introduce precise and uniform rules for dealing with evidence during the trial of cases.<\/span><\/p>\n

Replaces: <\/b>Indian Evidence Act, 1872.<\/span><\/p>\n

Privileged Communication between Ministers and President<\/b><\/td>\n1) The bill bars the courts from inquiring into any privileged communication between Ministers and the President<\/strong> of India.
\n<\/span>2) This will give legal backing to <\/strong><\/span>Article 74(2)<\/strong> of the Constitution<\/strong> which states that the advice given by the Council of Ministers to the President of India could not be inquired into by the courts.<\/span>
\n<\/span>3) However, what constitutes privileged communication has not been defined leaving the provision open to interpretation.<\/span><\/td>\n<\/tr>\n
Deletion of British legacy references\u00a0<\/b><\/td>\n1) The words like \u2018Vakil\u2019, \u2018Pleader\u2019 and \u2018Barrister\u2019 have been replaced<\/strong> with the word \u2018Advocate\u2019.
\n<\/span>2) Section 166 of the Act relating to the power of the jury to put forward questions has been deleted as the jury system has already been abolished in India.\u00a0<\/span><\/td>\n<\/tr>\n
Definition of Documents<\/b><\/td>\nIt has been expanded to include electronic or digital records<\/strong> on emails, server logs, documents on computers, laptops or smartphones, messages, websites and locational evidence and voice mail messages stored on digital devices.<\/span><\/td>\n<\/tr>\n
Definition of evidence\u00a0<\/b><\/td>\nIt has been expanded to include any information given electronically<\/strong> that will enable the appearance of witnesses, accused, experts and victims through electronic means.\u00a0<\/span><\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n
