{"id":27210,"date":"2018-10-23T12:00:18","date_gmt":"2018-10-23T06:30:18","guid":{"rendered":"https:\/\/blog.forumias.com\/?p=27210"},"modified":"2018-11-22T10:46:25","modified_gmt":"2018-11-22T05:16:25","slug":"reservation-in-promotions-disquiet-over-scs-ruling-on-creamy-layer-for-scs-sts","status":"publish","type":"post","link":"https:\/\/forumias.com\/blog\/reservation-in-promotions-disquiet-over-scs-ruling-on-creamy-layer-for-scs-sts\/","title":{"rendered":"Reservation in promotions: Disquiet over SC\u2019s ruling on creamy layer for SCs,\u00a0STs"},"content":{"rendered":"<p><a href=\"https:\/\/indianexpress.com\/article\/india\/reservation-in-promotions-disquiet-over-supreme-courts-ruling-on-creamy-layer-for-scs-and-sts-5377510\/\">Reservation in promotions: Disquiet over SC\u2019s ruling on creamy layer for SCs,\u00a0STs<\/a><\/p>\n<p><strong><u>News:<\/u><\/strong><\/p>\n<ol>\n<li>Government\u2019s dilemma over Supreme Court ruling on concept of creamy layer for SC\/STs.<\/li>\n<li>In the present judgment, the Supreme Court has decided not to collect data of backwardness to provide reservation to SC\/STs but it may consider the concept of creamy layer for SC\/ST.<\/li>\n<\/ol>\n<p><strong><u>Important Facts:<\/u><\/strong><\/p>\n<ol start=\"3\">\n<li>Supreme Court has said the concept of creamy layer to be applicable for SC\/STs, which, so far, was applicable to OBC only (Families with income above Rs. 8 lakhs\/ annum are not eligible for reservation).<\/li>\n<li><strong>It has been argued concept of creamy layer for SC\/STs will defeat the very purpose of reservation because:<\/strong><\/li>\n<\/ol>\n<ul>\n<li>Since the SC\/STs are already considered backward, further dividing them on the basis of economic backwardness to avail reservation may not sound appropriate.<\/li>\n<li>This verdict is in contrast to the judgment in the <strong>Ashok Thakur case in 2008<\/strong> when judges while providing the reservation to SC\/ST did not considered the concept the Creamy Layer..<\/li>\n<li>Economically prosperous SCs will continue to face discrimination in employment.<\/li>\n<li>Decision may also encourage the demand to implement the creamy layer criteria in the overall recruitment of SC\/STs (from selection to promotion).<\/li>\n<li>Nowhere in the world the reservation provided for equal access to job\/education is based on the economic criteria.<\/li>\n<li>Many sectors are being privatized and there is no reservation in private sector.<\/li>\n<\/ul>\n<ol start=\"5\">\n<li><strong>Supreme Court stand on its Judgement:<\/strong><\/li>\n<\/ol>\n<ul>\n<li>To ensure there is no discrimination against the poor\/backward category within the same class.<\/li>\n<li>Will enable the backward classes of citizen to move forward with other citizen of India on an equal basis.<\/li>\n<li>SC judgement is within the principal of equality under article 14 and 16 when excluding the creamy layer.<\/li>\n<li>Parliament will have complete freedom to include or exclude persons from the Presidential Lists based on relevant factors under Article 341 and 342 of the constitution.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Reservation in promotions: Disquiet over SC\u2019s ruling on creamy layer for SCs,\u00a0STs News: Government\u2019s dilemma over Supreme Court ruling on concept of creamy layer for SC\/STs.
