{"id":272277,"date":"2023-12-04T20:16:39","date_gmt":"2023-12-04T14:46:39","guid":{"rendered":"https:\/\/forumias.com\/blog\/?p=272277"},"modified":"2023-12-04T20:16:39","modified_gmt":"2023-12-04T14:46:39","slug":"geneva-convention-ukraine-accuses-russia-of-killing-surrendering-soldiers","status":"publish","type":"post","link":"https:\/\/forumias.com\/blog\/geneva-convention-ukraine-accuses-russia-of-killing-surrendering-soldiers\/","title":{"rendered":"Geneva Convention: Ukraine accuses Russia of killing surrendering soldiers"},"content":{"rendered":"<p><b>Source: <\/b><span style=\"font-weight: 400;\">The post is based on the article \u201c<\/span><b>Geneva Convention: <\/b><b>Ukraine accuses Russia of killing surrendering soldiers<\/b><b>\u201d<\/b><span style=\"font-weight: 400;\"> published in <\/span><b>\u201cThe Hindu\u201d on 4th December 2023<\/b><\/p>\n<h2>Why in the News?<\/h2>\n<p><span style=\"font-weight: 400;\">Ukraine has accused Russia of violating the Geneva Convention by executing <\/span><span style=\"font-weight: 400;\">two unarmed Ukrainian soldiers who had signaled their intention to surrender.<\/span><\/p>\n<h2>What is the Geneva Convention?<\/h2>\n<p><span style=\"font-weight: 400;\">The Geneva Conventions <\/span><span style=\"font-weight: 400;\">are a set of treaties and protocols that countries must follow during wartime.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">They aim to protect people who do not take part in the fighting (civilians, medics, aid workers) and those who can no longer fight (wounded, sick and shipwrecked troops, prisoners of war).<\/span><\/p>\n<p><b>Treaties and Protocols:<\/b><span style=\"font-weight: 400;\"> The convention consists of four treaties which were formalized in 1949 and three additional protocols which were formalized afterwards:<\/span><\/p>\n<p><b>Four Geneva Conventions:<\/b><\/p>\n<p><span style=\"font-weight: 400;\">1) <\/span><b>First<\/b><span style=\"font-weight: 400;\">: Protects wounded and sick soldiers on land during war.<\/span><\/p>\n<p>2) <b>Second: <\/b><span style=\"font-weight: 400;\">Protects wounded, sick and shipwrecked military personnel at sea during war.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">3) <\/span><b>Third: <\/b><span style=\"font-weight: 400;\">Applies to prisoners of war (POWs), detailing their humane treatment during their captivity.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">4) <\/span><b>Fourth: <\/b><span style=\"font-weight: 400;\">It offers protections to civilians, including those in the occupied territory.<\/span><\/p>\n<p><b>Three additional protocols:<\/b><\/p>\n<p><span style=\"font-weight: 400;\">1) <\/span><b>Protocol I (1977): <\/b><span style=\"font-weight: 400;\">Protecting victims in international conflicts, including wars of liberation and conflicts against racist regimes.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">2) <\/span><b>Protocol II (1977)<\/b><span style=\"font-weight: 400;\">:Focuses on protecting victims in non-international armed conflicts, such as civil wars.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">3) <\/span><b>Protocol III (2005)<\/b><span style=\"font-weight: 400;\">: It created <\/span><span style=\"font-weight: 400;\">an additional emblem, the Red Crystal, which has the same international status as the Red Cross and Red Crescent emblems.<\/span><\/p>\n<h2>Which countries are signatories to the Geneva Convention?<\/h2>\n<p><span style=\"font-weight: 400;\">1) The Geneva Conventions have been ratified by 196 states, including all UN member states. The three Protocols have been ratified by 174, 169 and 79 states respectively.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">2) India has ratified the Geneva Conventions. In addition, it has also ratified the third protocol of 2005. However, India did not ratify the additional protocols 1 and 2 of 1977.<\/span><\/p>\n<h2>What is the role of the International Committee for the Red Cross (ICRC)?<\/h2>\n<p><span style=\"font-weight: 400;\">1) International Committee of the Red Cross (ICRC) is a humanitarian organization based in Geneva, Switzerland.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">2) State parties to the Geneva Convention have given the <\/span><span style=\"font-weight: 400;\">ICRC the<\/span><span style=\"font-weight: 400;\"> mandate to protect victims of international and internal armed conflicts.<\/span><\/p>\n<h2>What is the potential prosecution under the Geneva Convention for war crimes?<\/h2>\n<p><span style=\"font-weight: 400;\">1) War Crimes\u2019 refers to <strong>grave breaches of the Geneva Conventions<\/strong> including wilful killing, torture or inhuman treatment, including biological experiments among others.<br \/>\n<\/span><\/p>\n<p><span style=\"font-weight: 400;\">2) Under <strong>Article 8 of the Rome Statute of the International Criminal Court<\/strong> (ICC), it is the ICC that has jurisdiction in respect of war crimes.<\/span><\/p>\n<p><strong>UPSC Syllabus: International Relations<\/strong><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Source: The post is based on the article \u201cGeneva Convention: Ukraine accuses Russia of killing surrendering soldiers\u201d published in \u201cThe Hindu\u201d on 4th December 2023 Why in the News?
