Its consequence is that the transfer of data across borders should be restricted.<\/li>\n<\/ol>\n<p><strong>Important Analysis<\/strong><\/p>\n<ol start=\"3\">\n<li>As the Internet continues to grow, data regulation gains the prominence in many countries.<\/li>\n<li>Digital society necessitates that data need to be subject under <strong>rule of law<\/strong> as it affects all spheres of social, economic and political life.<\/li>\n<li>It is the state\u2019s responsibility to protect personal data of citizens as privacy is a right \u00a0guaranteed under Article 21 of Indian Constitution.<\/li>\n<li>There are dangers to privacy of individuals from<\/li>\n<\/ol>\n<ul>\n<li>State agencies<\/li>\n<li>e-commerce companies<\/li>\n<li>social media companies<\/li>\n<\/ul>\n<ol start=\"7\">\n<li>\u00a0The writer advocated that the <strong>new data protection authority<\/strong> (proposed by Srikrishna Committee) to be a constitutional authority.<\/li>\n<li>India\u2019s <strong>cloud computing policy<\/strong> and <strong>draft national e-commerce policy<\/strong> would likely recommend that data generated in the country must be stored locally.<\/li>\n<\/ol>\n<p><strong>Data as a resource<\/strong><\/p>\n<ol start=\"9\">\n<li>Data has become one of the most vital resources of the century.<\/li>\n<li>\u00a0Countries like European Union, France and U.K. and India are proposing <strong>national data-sharing regimes<\/strong> and <strong>data infrastructures<\/strong> especially for data that are generated by users on digital platforms (also known as \u2018community data\u2019).<\/li>\n<\/ol>\n<ul>\n<li>Data with companies like Uber is an example of community data.<\/li>\n<\/ul>\n<ol start=\"11\">\n<li>\u00a0\u00a0These regimes necessitated the law to have access to shareable data.<\/li>\n<li>\u00a0\u00a0Also, data is required for<\/li>\n<\/ol>\n<ul>\n<li>Policymaking<\/li>\n<li>Governance<\/li>\n<li>Smart traffic planning<\/li>\n<\/ul>\n<ol start=\"13\">\n<li>\u00a0\u00a0The proposed law cannot achieve its purpose if data can easily cross borders.<\/li>\n<li>\u00a0\u00a0Therefore regulations are needed for storage, processing and cross-border flow of data.<\/li>\n<\/ol>\n<p><strong>Need for data localization<\/strong><\/p>\n<ol start=\"15\">\n<li>\u00a0\u00a0The Srikrishna Committee wants to localise data for<\/li>\n<\/ol>\n<ul>\n<li>law enforcement agencies to have easy access to data<\/li>\n<li>to prevent foreign surveillance<\/li>\n<li>to build an artificial intelligence ecosystem in India<\/li>\n<li>Prevent undersea cables through which data transfers take place from attacks<\/li>\n<\/ul>\n<ol start=\"16\">\n<li>Recently, the Reserve Bank of India imposed a hard data localisation mandate on payment systems providers to store payment systems data only in India.<\/li>\n<li>The writer suggests that free flow should be allowed for general information and knowledge.<\/li>\n<li>Data between consenting jurisdictions can be regulated through mutual treaties as EU has done with its digital single market.<\/li>\n<\/ol>\n<p><strong>Data flow needs to be checked<\/strong><\/p>\n<ol start=\"19\">\n<li>Allowing unchecked free flow of data would mean withdrawal of the state from key social and economic roles.<\/li>\n<li>In pursuance of this, all major countries like U.S., Germany, Indonesia, South Korea, Russia, China and EU have some kind of proposals for data localization.<\/li>\n<\/ol>\n<p><strong>Way Forward<\/strong><\/p>\n<ol start=\"21\">\n<li>\u00a0A balance needs to achieved between the interest of these companies and the interests of those whose livelihoods are attached to these economies.<\/li>\n<li>Also, fears of state surveillance need to be balanced with the imperatives of a strong enough state that can protect people\u2019s interest.<\/li>\n<\/ol>\n","protected":false},"excerpt":{"rendered":"<p>Bringing data under the rule of law Article Parminder Jeet Singh initiates a debate that legal and democratic requirements for data localization need to be balanced with the values of global digital integration.
