{"id":27410,"date":"2018-10-23T13:58:12","date_gmt":"2018-10-23T08:28:12","guid":{"rendered":"https:\/\/blog.forumias.com\/?p=27410"},"modified":"2018-10-23T13:58:12","modified_gmt":"2018-10-23T08:28:12","slug":"the-progressive-way","status":"publish","type":"post","link":"https:\/\/forumias.com\/blog\/the-progressive-way\/","title":{"rendered":"The progressive way"},"content":{"rendered":"<p><a href=\"https:\/\/www.thehindu.com\/opinion\/op-ed\/the-progressive-way\/article24970676.ece\">The progressive way<\/a><\/p>\n<p><strong><u>Article<\/u><\/strong><\/p>\n<ol>\n<li>\u00a0Faizan Mustafa pointed out that there is no need to mend personal laws for the sake of uniformity in a multi-diverse country like India.<\/li>\n<li>\u00a0Recently Law India submitted a \u2018Report on Family Law\u2019.<\/li>\n<li>\u00a0It stated that uniform civil Commission of code is neither desirable nor necessary for a multi-religious country and social democracy like India.<\/li>\n<\/ol>\n<p><strong><u>What is Uniform Civil Code(UCC)?<\/u><\/strong><\/p>\n<ol start=\"4\">\n<li>\u00a0Uniform Civil Code is a proposal to replace personal laws of different communities with a common set of laws governing all citizens.<\/li>\n<\/ol>\n<p><strong><u>Constitution Provision<\/u><\/strong><\/p>\n<ol start=\"5\">\n<li>\u00a0Article 44 of the Indian Constitution states,\u201d The State shall endeavour to secure for citizens a uniform civil code throughout the territory of India.&#8221;<\/li>\n<\/ol>\n<p><strong>Debate between legal pluralism and radical libertarianism<\/strong><\/p>\n<ol start=\"6\">\n<li>\u00a0<u>Legal Pluralism<\/u>&#8211; Legal pluralism is the existence of multiple legal systems within one (human) population and\/or geographic area.<\/li>\n<li>\u00a0<u>Radical Libertarianism<\/u>&#8211; Libertarians uphold liberty as a core principle. They emphasize freedom of choice, individual judgement, etc.<\/li>\n<li>\u00a0The writer states that in history we have pluralistic legal systems where multiple sources of law existed therefore there is no need of uniformity rather what we need is just laws.<\/li>\n<li>\u00a0The Law Commission also recognised plurality of diverse personal laws and proposed internal reforms in personal reforms to make them compatible with the constitutional provisions of equality and non-discrimination.<\/li>\n<li>\u00a0\u00a0In pursuance of Law Commission report, religious communities should take steps to initiate internal reforms in personal laws.<\/li>\n<\/ol>\n<p><strong><u>Supreme Court Judgements<\/u><\/strong><\/p>\n<ul>\n<li><strong><em>ABC v. The State (NCT of Delhi)- <\/em><\/strong>SC stated that DPSP envisages about uniform civil code. But the writer suggested this case is not dealing with any personal law rather with the provisions of Guardians and Wards Act, 1890.<\/li>\n<li>In <strong>Saral Mudgal(2015)-<\/strong> SC \u00a0stated that those who stayed back in India after partition knew that India believes in one nation and no community can claim separate religious laws.<\/li>\n<li><strong>Constituent Assembly debates<\/strong>&#8211; Constitutional maker were divided whether to put UCC as a justiciable rights under Part III or non-justiciable rights under Part IV.<\/li>\n<\/ul>\n<p><strong><u>Preserving legal diversity<\/u><\/strong><\/p>\n<ol start=\"11\">\n<li>\u00a0\u00a0Article 44 has used the term \u2018uniform\u2019 not \u2018common\u2019 because uniform means \u2018same in similar conditions\u2019.<\/li>\n<li>\u00a0\u00a0The constitutional makers has included \u2018personal laws\u2019 in the concurrent list to preserve legal diversity. The Law Commission further affirmed it in the report.<\/li>\n<\/ol>\n<p><strong><u>Diversity in different laws<\/u><\/strong><\/p>\n<ol start=\"13\">\n<li>\u00a0\u00a0Even criminal laws are not uniform in our country. States have mend the Indian Penal Code(IPC), 1860, and the Criminal Procedure Code(CrPC), 1973.<\/li>\n<\/ol>\n<ul>\n<li>Recently, Punjab introduced Section 295AA to the IPC- life term in all sacrilege cases.<\/li>\n<\/ul>\n<ol start=\"14\">\n<li>\u00a0\u00a0Similarly, Hindus also do not have uniform laws.
