Bill to restore anticipatory bail clause referred to President<\/a><\/p>\n<p><strong><u>News<\/u><\/strong><\/p>\n<p>Uttar Pradesh Governor has referred a bill to restore <strong>anticipatory bail clause<\/strong> for presidential assent.<\/p>\n<p><strong><u>Important Facts<\/u><\/strong><\/p>\n<ol start=\"2\">\n<li>\u00a0 Provision of Anticipatory Bail was <strong>repealed in UP during 1976 emergency<\/strong>.<\/li>\n<li>\u00a0\u00a0<strong>Uttar Pradesh<\/strong> and <strong>Uttarakhand<\/strong> are the only two states in India with no Anticipatory Bail provision.<\/li>\n<li>\u00a0<strong>About Anticipatory \u00a0bail<\/strong><\/li>\n<\/ol>\n<ul>\n<li>\u00a0A provision under <strong>section 438 of Criminal procedure code<\/strong>.<\/li>\n<li>A person can seek bail in expectation o being named or accused for a non-bailable offence.<\/li>\n<li>Safeguard against false accusation.<\/li>\n<li>Person must approach court citing section 438 of CrPC to get bail.<\/li>\n<\/ul>\n<p><strong>Anticipatory Bail in UP: A Timeline<\/strong><\/p>\n<ul>\n<li>1976: <strong>Revoked during emergency<\/strong> by then UP CM to rein in protest against the government.<\/li>\n<li>2009: State law commission made a recommendation for reintroduction of a modified bill.<\/li>\n<li>2010: Passed by assembly and sent for president\u2019s assent; Put on hold by centre.<\/li>\n<\/ul>\n<p><strong><u>All about the Amendment Bill<\/u><\/strong><\/p>\n<p>4.\u00a0<strong>Name of the Amendment Bill: <\/strong>Code of Criminal Procedure (Uttar Pradesh Amendment) Bill, 2018.<\/p>\n<p>5.\u00a0<strong>Salient Features<\/strong><\/p>\n<p>Unlike the Section 438 of CrPC which gave court discretion to impose certain condition for granting bail this amendment bill has made <strong>certain riders mandatory<\/strong> which includes:<\/p>\n<ul>\n<li>Accused should be present for interrogation whenever required by police.<\/li>\n<li>Accused <strong>cannot threaten<\/strong> anyone involved with the case and <strong>cannot leave country.<\/strong><\/li>\n<li>Not necessary for the accused to be present for court hearing.<\/li>\n<li>There will <strong>be no Anticipatory Bail<\/strong> in cases where punishment is <strong>death sentence<\/strong> and also cases under <strong>gangster\u2019s act.<\/strong><\/li>\n<li>Court will have to decide on Anticipatory Bail <strong>within 30 days<\/strong> of filling of such application.<\/li>\n<\/ul>\n<p>6.
