Now, the matter has been <span style=\"color: #ff0000;\">referred to the Chief Justice of India<\/span> to form a three-judge bench for a decisive ruling on corruption charges against Naidu.<\/p>\n<h2>What does the Supreme Court held?<\/h2>\n<p>1) Justice Bose held that <span style=\"color: #ff0000;\">prior approval was necessary<\/span> before conducting an inquiry into the allegations against Naidu, which the CID did not have when it opened the inquiry.<\/p>\n<p>2) Justice Trivedi held it was necessary to seek approval under Section 17A of the PCA Act <span style=\"color: #ff0000;\">only to investigate offences committed after 2018,<\/span> the year this requirement was introduced.<\/p>\n<h2>What is the &#8216;Prior approval&#8217; requirement?<\/h2>\n<p>1) In 2003, an amendment to the Delhi Special Police Establishment Act, 1946 (specifically Section 6A) was made.<\/p>\n<p>2) It mandated that agencies like the CBI are <span style=\"color: #ff0000;\">required to seek central government approval<\/span> before probing alleged offenses under the <span style=\"color: #ff0000;\">Prevention of Corruption Act (PCA), 1988,<\/span> if the implicated employee held a rank higher than joint secretary.<\/p>\n<p>3) The Supreme Court <span style=\"color: #ff0000;\">eliminated<\/span> this requirement in 2014.<\/p>\n<p>4) <span style=\"color: #ff0000;\">In 2018, the PCA underwent an amendment<\/span>, incorporating a comparable provision as <span style=\"color: #ff0000;\">Section 17A. <\/span><\/p>\n<p>5) <strong>According to section 17A,<\/strong> if a public servant commits an offense under the Act <span style=\"color: #ff0000;\">during official duties<\/span>, investigators <span style=\"color: #ff0000;\">must receive approval from the central\/state government<\/span> or a competent authority to initiate an inquiry or investigation.<\/p>\n<h2>What are the similar cases in which the Supreme Court addressed the prior approval issue?<\/h2>\n<p><strong>CBI v R R Kishore-<\/strong> A Constitution Bench ruled that officials cannot assert immunity under Section 6A, even if the offense occurred prior to the annulment of this provision.<\/p>\n<p><strong>UPSC Syllabus- Polity and Nation<\/strong><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Source-This post is based on the article &#8220;What is \u2018prior approval\u2019, and why is it needed before investigating public officials accused of corruption?&#8221; published in &#8220;The Indian Express&#8221; on 17th January 2024.
