According to the government, the newly passed Post Office Act 2023 is an attempt to ensure the <span style=\"color: #ff0000;\">effective functioning of the Postal Department<\/span> as a <span style=\"color: #ff0000;\">messenger service<\/span> and as a <span style=\"color: #ff0000;\">provider of banking facilities<\/span>. This is in line with the decolonisation of various laws like the <span style=\"color: #ff0000;\">IPC<\/span> and <span style=\"color: #ff0000;\">CrPC<\/span>.<\/p>\n<p>2. <strong>Addresses the evolving role of Post Offices in India-\u00a0<\/strong>The role of Post Offices have been evolving in India like the banking roles (creation of India Post Payment Bank). The new Act incorporates provisions to address these evolving roles.<strong> For Ex-<\/strong> <span style=\"color: #ff0000;\">Creation of Director General of Postal Services to identify the new services<\/span> which can be offered by post Offices like <span style=\"color: #ff0000;\">service delivery<\/span>.<\/p>\n<p>3. <strong>Increased autonomy and Independence-<\/strong> The Indian Post can determine its own rates of services. This may <span style=\"color: #ff0000;\">violate the right to privacy<\/span>, and the <span style=\"color: #ff0000;\">freedom of speech and expression<\/span>. <strong><span style=\"color: #333333;\">For Ex-<\/span><\/strong> Previous acts like the Telegraph Act and the IT Act have rules of interception to prevent violation of right to privacy like <span style=\"color: #ff0000;\">Telegraph Rules, 2007<\/span> and <span style=\"color: #ff0000;\">IT Rules, 2009<\/span>.<\/p>\n<p>2. <strong>Vague Definition of \u2018Emergency\u2019-<\/strong> The Act allows interception in \u2019emergencies\u2019 but doesn\u2019t define emergency. This will lead to <span style=\"color: #ff0000;\">potential arbitrary use of power<\/span>.<\/p>\n<p>3. <strong>Exemption from Liability for Lapses in Services- <\/strong>The new Act <span style=\"color: #333333;\">removes liabilities of the postal department officials <\/span>with respect to postal delivery. This is in <span style=\"color: #ff0000;\">contrast with the rules of liability<\/span> of other commercial service providers of the government, like the <span style=\"color: #ff0000;\">Indian railways<\/span>. <strong>For ex- <\/strong><span style=\"color: #ff0000;\">Railway Claims Tribunal Act, 1987<\/span> provides for tribunals to <span style=\"color: #ff0000;\">hear cases of liabilities and lapses<\/span> against railway officials.<\/p>\n<p>4. <strong>Removal of all Offenses and Penalties-<\/strong> The earlier offences and penalities against the postal officials in <span style=\"color: #ff0000;\">cases of theft<\/span>, <span style=\"color: #ff0000;\">illegal opening of postal articles<\/span> etc. have been removed in the new act. This may have adverse implications for the right to privacy of individuals.<\/p>\n<p>5. <strong>Against India&#8217;s International obligations-<\/strong> <span style=\"color: #ff0000;\">Article 17<\/span> of the <span style=\"color: #ff0000;\">International Covenant on Civil and Political Rights states<\/span> that <span style=\"color: #ff0000;\">no one should face arbitrary interference<\/span> with their <span style=\"color: #ff0000;\">privacy<\/span>. As India is a signatory to the International Covenant on Civil and Political Rights, the new act contradicts with India&#8217;s international obligations.<\/p>\n<p>6. <strong>Against the SC rulings and Law Commission recommendations-<\/strong> SC in <span style=\"color: #ff0000;\">K.S. Puttaswamy case<\/span> (<span style=\"color: #ff0000;\">2017<\/span>) held the right to communication as a part of the right to privacy to be protected under Article 21 of the Constitution. Further, the <span style=\"color: #ff0000;\">38th Report of Law Commission on Indian Post Office Act, 1898\u00a0<span style=\"color: #333333;\">recommended the incorporation of an explicit definition of &#8216;public emergency&#8217; in the act.
