{"id":28062,"date":"2018-10-23T17:54:30","date_gmt":"2018-10-23T12:24:30","guid":{"rendered":"https:\/\/blog.forumias.com\/?p=28062"},"modified":"2018-10-23T17:54:30","modified_gmt":"2018-10-23T12:24:30","slug":"adultery-law-violates-the-dignity-of-woman-says-sc","status":"publish","type":"post","link":"https:\/\/forumias.com\/blog\/adultery-law-violates-the-dignity-of-woman-says-sc\/","title":{"rendered":"Adultery law violates the dignity of woman, says SC"},"content":{"rendered":"<p><a href=\"https:\/\/www.thehindu.com\/todays-paper\/tp-national\/adultery-law-violates-the-dignity-of-woman-says-sc\/article24586785.ece\"><span style=\"font-weight: 400;\">Adultery law violates the dignity of woman, says SC<\/span><\/a><\/p>\n<p><b>News:<\/b><\/p>\n<ol>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Recently, the Supreme Court said that adultery law violates the right to equality of woman.<\/span><\/li>\n<\/ol>\n<p><b>Important facts:<\/b><\/p>\n<ol>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The court made the observation while hearing a case challenging the validity of the penal law, which makes adultery an offence punishable only for men and not the consenting women.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The meaning of \u2018Adultery is defined under section 497 of the Indian Penal Code as follows:<\/span><\/li>\n<\/ol>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Section 497 says that a man could be punished up to five years in jail if he has sexual intercourse with other man\u2019s wife.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">However, it is not an offence if the sexual intercourse is with the \u201cconsent or connivance\u201d of the husband of the woman.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">3. The Supreme court has made the following observations in this regard:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The adultery law violates the dignity of a woman.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The Bench said the IPC section treat a married woman as \u201cchattel\u201d(a personal possession) of the conniving husband, which was \u201cabsurd\u201d.<\/span><\/li>\n<\/ul>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">\u201cWhen a woman is treated as chattel, her right to dignity is affected.\u201d<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Decriminalising adultery was not \u201ca licence for people to go indulge in it\u201d.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Adultery is a sign of marital breakdown as marriage as an institution has two pillars where both parties have to be equally responsible.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">However, the judgment is criticizing by many people for being unconstitutional.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">4.
