Statutory Transfers to the States (Based on Legal Provisions and the criteria of FC)-<\/strong>\u00a0<span style=\"color: #ff0000;\">Net Tax Revenues <span style=\"color: #333333;\">and<\/span> Grant-In Aids <span style=\"color: #333333;\">form the two statutory transfers to the states by the Central Government.<\/span><\/span><br \/>\n<strong>a. Finance Commission-<\/strong> <span style=\"color: #ff0000;\">Article 280<\/span> of the constitution, provides for the constitution of Finance Commission to recommend <span style=\"color: #ff0000;\">the distribution of net tax revenues<\/span> between the central government and the state governments.<br \/>\n<strong>b. Grant in Aids-<\/strong> <span style=\"color: #ff0000;\">Article 275<\/span> of the constitution provides for Grant in Aids, which involves the discretionary transfer of funds from the central government to state governments for specific purposes or schemes. <span style=\"color: #ff0000;\">The Grant in Aids are recommended by the Finance Commission<\/span>.<\/p>\n<p><strong>NOTE-<\/strong> The Finance Commission has been granted the power by the constitution to recommend only the distribution of net tax revenues among the states.<br \/>\n<strong>Net Tax Revenue= Gross Tax Revenue &#8211; Tax administration expenditure &#8211; Revenue collections from Union Territories &#8211; Cess and surcharge<br \/>\n<\/strong>* Thus, <span style=\"color: #ff0000;\">according to the constitution<\/span>, <span style=\"color: #ff0000;\">cess and surcharges are not needed to be devolved<\/span> by the <span style=\"color: #ff0000;\">Central Government to the state government<\/span>.<\/p>\n<p><strong>2. Non-Statutory Transfers to the States (Not Based on any Legal Provisions or criteria of FC)-<\/strong>\u00a0<span style=\"color: #333333;\">The financial transfers through <span style=\"color: #ff0000;\">Centrally Sponsored Schemes<\/span> (<span style=\"color: #ff0000;\">CSS<\/span>) and <span style=\"color: #ff0000;\">Central Sector Schemes<\/span> (<span style=\"color: #ff0000;\">CSec<\/span>) are non-statutory transfers to the states. These <span style=\"color: #ff0000;\">non-statutory grants are tied grants<\/span>&#8211; they have to be spent on specific schemes for which the grants are allocated.<\/span><\/p>\n<p><strong>NOTE<\/strong><br \/>\n<strong>Centrally Sponsored Schemes (CSS Schemes)-<\/strong> These schemes <span style=\"color: #ff0000;\">require matching financial contribution from the state governments<\/span> from their own budgetary resources.<br \/>\n<strong>Central Sector Schemes (CSec Schemes)- <\/strong>These schemes are <span style=\"color: #ff0000;\">fully funded by the Union government<\/span> in sectors where the Union government has exclusive legislative or institutional controls.<\/p>\n<h2><span style=\"color: #000000;\"><strong><a id=\"toc2\"><\/a>What are The Fiscal Centralisation Concerns being Raised?<\/strong><\/span><\/h2>\n<p><strong>1. Reduced Financial Transfers to the States-\u00a0<\/strong>The <span style=\"color: #ff0000;\">share of states in the gross tax revenue<\/span> (total tax revenue collected, which includes cess and surcharges) has <span style=\"color: #ff0000;\">decreased<\/span> from<span style=\"color: #ff0000;\"> 35% in 2015-16<\/span> to <span style=\"color: #ff0000;\">30% in 2023-24<\/span>.<\/p>\n<p><strong>2. Disproportionate Growth between Union Govt\u2019s &amp; State Govt&#8217;s Revenue- <\/strong>From 2015-16 to 2023-24, while the <span style=\"color: #ff0000;\">Union government\u2019s tax revenue<\/span> <span style=\"color: #ff0000;\">has increased by 2.3 times<\/span> from \u20b914.6 lakh crore to \u20b933.6 lakh crore, the <span style=\"color: #ff0000;\">states\u2019 share in the tax revenue has only doubled<\/span> from \u20b95.1 lakh crore to \u20b910.2 lakh crore. This indicates a disproportionate growth between Union Govt&#8217;s and State Govt&#8217;s Revenues.<\/p>\n<p><strong>3.<\/strong> <strong>Decrease in Grants-in-Aid to the states-<\/strong> Direct financial support to states, in the form of grants-in-aid, has <span style=\"color: #ff0000;\">declined from<\/span> <span style=\"color: #ff0000;\">\u20b91.95 lakh crore in 2015-16<\/span> to <span style=\"color: #ff0000;\">\u20b91.65 lakh crore in 2023-24<\/span>.<\/p>\n<p><strong>4.<\/strong> <strong>Increase in the share of non-devolvable cess and surcharge-<\/strong> The share of collected cess and surcharge (<span style=\"color: #ff0000;\">which are not shared with states<\/span>) has increased from <span style=\"color: #ff0000;\">Rs. 85,638 in 2015-16<\/span> (5.9% of the Union government\u2019s tax revenue) to<span style=\"color: #ff0000;\"> Rs. 3.63 lakh crore in 2023-24<\/span> (10.8% of the Union Govt&#8217;s tax revenue).<\/p>\n<p><strong>5.\u00a0Centralisation of Public Expenditure-<\/strong> Out of the<span style=\"color: #ff0000;\"> combined allocation of \u20b919.4 lakh crore<\/span> for Centrally Sponsored Schemes (CSS) and Central Sector Schemes (CSec Schemes) in 2023-24, <span style=\"color: #ff0000;\">only \u20b94.25 lakh crore was devolved to States<\/span>. These are <span style=\"color: #ff0000;\">tied grants<\/span> and the states have no autonomy to plan their expenditure.<\/p>\n<p><strong>6. Erosion of State Taxation Autonomy on account of implementation of GST-<\/strong> The ability of states to set tax rates on their own revenue sources has been significantly diminished due to the implementation of GST. <strong>For ex-<\/strong> <span style=\"color: #ff0000;\">State VAT have been subsumed under GST<\/span>.<\/p>\n<p><strong>7. Accentuation of inter-State inequality in public finances-<\/strong> Less wealthy states have been <span style=\"color: #ff0000;\">forced to commit their borrowed finances<\/span> to <span style=\"color: #ff0000;\">avail the matching contribution from the central government<\/span> for the implementation of Centrally Sponsored Scheme (CSS). This has increased the borrowings and liabilities of less-wealthy states and has accentuated inter-state inequality in public finances.<\/p>\n<p><strong>3. Potential Bias in Resource Allocation-<\/strong> The complete funding of Central Sector Schemes by the Central Government has raised concerns of unequal treatment among states. There is a <span style=\"color: #ff0000;\">possibility of the Union government favouring certain states<\/span> <span style=\"color: #ff0000;\">or regions<\/span> through Central Sector Schemes.<\/p>\n<p><strong>4. Impingement on the principles of Fiscal Federalism-<\/strong> Increased centralised control over finances, with <span style=\"color: #ff0000;\">less revenue sharing with states<\/span>, goes against the principles of cooperative and fiscal federalism.<\/p>\n<p><strong>5. Fuelling regional separatism-<\/strong> The fiscal consolidation and redistribution imbalances has led to growth of regionalism and separatist feelings in<span style=\"color: #ff0000;\"> southern states<\/span>, as they have undergone larger loss of tax revenue on account of GST implementation.<\/p>\n<p>This fiscal centralisation goes against the principle of fiscal federalism, which was displayed in the implementation of GST. Further, the <span style=\"color: #ff0000;\">principles of Vertical and Horizontal devolution<\/span>, <span style=\"color: #ff0000;\">must be relooked<\/span> to ensure equitable distribution of taxes among the states.<\/p>\n<p><strong>2. Rationalisation of Public Expenditure by Central Govt-<\/strong> A mechanism must be instituted for thorough <span style=\"color: #ff0000;\">financial rationalisation of the Central Sector<\/span> and <span style=\"color: #ff0000;\">Centrally Sponsored schemes<span style=\"color: #333333;\">,<\/span><\/span> in collaboration with state governments.<\/p>\n<p><strong>3. Addressing the GST related Concerns-\u00a0<\/strong>The anomalies in GST like the<span style=\"color: #ff0000;\"> Integrated GST<\/span> which favours the consuming states like UP and Bihar, rather than the producing states of TN, Gujarat must be corrected. Also, efforts must be undertaken to <span style=\"color: #ff0000;\">open more avenues for revenue generation by broadening the scope of GST<\/span> to include petrol, diesel etc.<\/p>\n<p><strong>4. Revisiting Article 246 and the Seventh Schedule-\u00a0<\/strong>The taxation powers listed in the seventh schedule must be relooked in the context of fiscal federalism. Rationalisation of Central Sector and Centrally sponsored schemes must be undertaken.<\/p>\n<p><strong>5. List of Taxation for Third Tier of Govt-<\/strong> <span style=\"color: #ff0000;\">Specific taxation powers must be devolved to the local self governments<\/span> to help them raise their own resources and reduce their dependence on grant-in-aids.
