This bill effectively <span style=\"color: #ff0000;\">decriminalizes<\/span> almost all penal provisions <span style=\"color: #ff0000;\">except<\/span> sections 25 and 26 in the earlier 1974 Water (Prevention and Control of Pollution) Act.<\/p>\n<p><span style=\"color: #ff0000;\">Section 25<\/span> pertains to the mandatory requirement of obtaining consent to operate from state pollution boards, while <span style=\"color: #ff0000;\">section 26<\/span> deals with the discharge of sewage or trade effluents.<\/p>\n<h2>What is Water (Prevention and Control of Pollution) Amendment Bill 2024<\/h2>\n<figure id=\"attachment_281811\" aria-describedby=\"caption-attachment-281811\" style=\"width: 300px\" class=\"wp-caption alignnone\"><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-281811\" src=\"https:\/\/i0.wp.com\/forumias.com\/blog\/wp-content\/uploads\/2024\/02\/water-prevention-and-control-of-pollution-amendment-bill-2024.png?resize=300%2C187&#038;ssl=1\" alt=\"water (prevention and control of pollution) amendment bill, 2024\" width=\"300\" height=\"187\" srcset=\"https:\/\/i0.wp.com\/forumias.com\/blog\/wp-content\/uploads\/2024\/02\/water-prevention-and-control-of-pollution-amendment-bill-2024.png?resize=300%2C187&amp;ssl=1 300w, https:\/\/i0.wp.com\/forumias.com\/blog\/wp-content\/uploads\/2024\/02\/water-prevention-and-control-of-pollution-amendment-bill-2024.png?w=581&amp;ssl=1 581w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/><figcaption id=\"caption-attachment-281811\" class=\"wp-caption-text\">Source-News On AIR<\/figcaption><\/figure>\n<p>1. <strong>To amend<\/strong>&#8211; The Water (Prevention and Control of Pollution) Act 1974.<\/p>\n<p>2. <strong>Applicability<\/strong>&#8211; Initially, its application will be limited to <span style=\"color: #ff0000;\">Himachal Pradesh, Rajasthan, and the union territories<\/span>. Other states have the option to pass resolutions to extend its applicability within their jurisdictions.<\/p>\n<p><strong>Key provisions of the bill:<\/strong><\/p>\n<p><strong>1.<\/strong> <strong>Industrial Establishment Consent Exemptions<\/strong>:- According to <span style=\"color: #ff0000;\">Section 25<\/span> of the 1974 Act, <span style=\"color: #ff0000;\">approval from the SPCB was needed<\/span> before setting up any outlet expected to release sewage or trade effluent into water bodies, sewers, or land. However, the proposed bill provides certain Industrial Establishment Consent exemptions-<br \/>\n<strong>a.<\/strong> The proposed Bill <span style=\"color: #ff0000;\">allows the Central government<\/span>, in consultation with the CPCB, to <span style=\"color: #ff0000;\">exempt<\/span> specific industrial plants from this requirement.<br \/>\n<strong>b.<\/strong> The <span style=\"color: #ff0000;\">central government may issue guidelines for granting, refusing, or revoking consent granted<\/span> by the SPCB.<\/p>\n<p><strong>2.<\/strong> <strong>Additional penal provision under section 25 of the Act-<\/strong> The bill <span style=\"color: #ff0000;\">retains the penal provision under Section 25<\/span> of the original Act. The<span style=\"color: #ff0000;\"> establishment and operation of an industry without obtaining SPCB consent<\/span> will still be punishable with imprisonment up to<span style=\"color: #ff0000;\"> six years and fine.<\/span><br \/>\nIt also <span style=\"color: #ff0000;\">introduces an additional penalty<\/span> between Rs 10,000 and Rs 15 lakh<span style=\"color: #ff0000;\"> for tampering with monitoring devices<\/span> used to determine the setting up of any industry or treatment plant.<\/p>\n<p><strong>3. Selection of Chairman of State Pollution Control Board-<\/strong> Under the 1974 Act, the state government nominated the chairman of a State Pollution Control Board (SPCB). However, according to the amendment Bill now, <span style=\"color: #ff0000;\">central government will determine the nomination process<\/span> and <span style=\"color: #ff0000;\">the terms of service<\/span> for the chairman of SPCB.<\/p>\n<p><strong>4. Offences related to polluting matter:<br \/>\na. Change of imprisonment to fines in pollution offence-<\/strong> Under the 1974 Act, the offenders of discharge of polluting matter faced imprisonment between one and a half to six years. The 2024 amendment Bill <span style=\"color: #ff0000;\">replaces imprisonment with penalties<\/span> ranging from Rs 10,000 to Rs 15 lakh.<br \/>\n<span style=\"color: #ff0000;\"><span style=\"color: #333333;\"><strong>b. Imprisonment in case of failure to pay fines-<\/strong><\/span> <\/span><span style=\"color: #ff0000;\">Failure to pay penalties may lead to imprisonment<\/span> up to three years or a fine double the penalty amount.<\/p>\n<p><strong>5.
