This move addresses the need for a <span style=\"color: #ff0000;\">legal framework<\/span> to manage the unregulated growth of private coaching centres. Ensure Mental well-being of students- <\/strong>The coaching centres <span style=\"color: #ff0000;\">must provide weekly off<\/span> for students. The curriculum must be <span style=\"color: #ff0000;\">suitably spaced-out<\/span> and the duration of classes must not be longer than five hours a day.<\/p>\n<p><strong>4. Customised leaves and co-curricular activities-<\/strong> Coaching centres will have to provide Customised leaves to students for &#8220;<span style=\"color: #ff0000;\">emotional boosting<\/span>&#8221; and &#8220;<span style=\"color: #ff0000;\">connection with family<\/span>&#8220;. Also, co-curricular activities, life skills, counselling from a psychologist, emotional bonding and mental well-being will have to be prioritised in coaching centres<\/p>\n<p><strong>5. Qualification of Tutors-<\/strong> Tutors with <span style=\"color: #ff0000;\">qualifications less than graduation degree<\/span> should not be allowed to teach in coaching institutes.<\/p>\n<p><strong>6. Maintenance of Website-<\/strong> Coaching centres will be required to maintain a website with <span style=\"color: #ff0000;\">updated details<\/span> of the <span style=\"color: #ff0000;\">qualification of tutors<\/span>, <span style=\"color: #ff0000;\">courses or curriculum<\/span>, duration of course, hostel facilities and the fees being charged.<\/p>\n<p><strong>7. Exit Option from the Course-<\/strong> In case when a student wishes to exit the course, coaching centres must refund fees fully paid by a student on a <span style=\"color: #ff0000;\">pro-rata basis within 10 days<\/span>. An easy exit policy and details of a fee refund policy will also have to be furnished on the website.<\/p>\n<p><strong>8. Filing complaints of complaints-<\/strong> The guidelines provide provisions for filing complaints before \u201c<span style=\"color: #ff0000;\">a competent authority<\/span>\u201d against the coaching centres by the student, parent or even tutor. The complaints will have to be <span style=\"color: #ff0000;\">disposed of within thirty days<\/span>.<\/p>\n<p><strong>9. Penal Provisions-<\/strong> <span style=\"color: #ff0000;\">Fine of up to 1 lakh or cancellation of registration<\/span>, if coaching centres charge exorbitant fees from students, cause undue stress leading to student suicide and other malpractices.<\/p>\n<p><strong>10. Regulation and Monitoring-<\/strong> State governments will have to undertake <span style=\"color: #ff0000;\">registration of new and existing coaching centres, within three months<\/span> after the guidelines come into effect. The state government will be responsible for monitoring and regulating the activities of the coaching centre.<\/p>\n<h2><span style=\"color: #000000;\"><strong><a id=\"toc2\"><\/a>What Factors have Led to The Growth of Coaching Centres in India?<\/strong><\/span><\/h2>\n<p><strong>1. Need of Conceptual education-<\/strong> The school education system is<span style=\"color: #ff0000;\"> rote-oriented. C<\/span><span style=\"color: #ff0000;\">onceptual clarity is required to clear competitive exams like<\/span> JEE and NEET.<\/p>\n<p><strong>2. Shadow of broken education system-<\/strong> Coachings shadow the <span style=\"color: #ff0000;\">dysfunctional school education system<\/span> in India, which is reflected by the presence of coaching to pass class 10th or 12th Board exams in India.<\/p>\n<p><strong>3. Parental Dream and pressure-<\/strong> The dream of parents <span style=\"color: #ff0000;\">for their wards to secure a seat in a prestigious medical or engineering college<\/span> has also led to the proliferation of private coaching centres in India.<\/p>\n<p><strong>4. Cracking ultra-competitive examinations-<\/strong> The <span style=\"color: #ff0000;\">difficulty levels of public exams<\/span> in India have <span style=\"color: #ff0000;\">become harder<\/span> because of more competition. Coachings provide structured help students get to crack these ultra-competitive exams like UPSC, NEET, IIT.<\/p>\n<p><strong>5.<\/strong> <strong>Societal construct of success-<\/strong> <span style=\"color: #ff0000;\">Qualification in competitive exams<\/span> like UPSC, IIT, NEET, CAT is considered a <span style=\"color: #ff0000;\">benchmark of success in the society<\/span>. There is absence of social appreciation for alternate profession like chef, fashion designing, entrepreneurship etc. Thus, this societal construct of a successful life and career have led to mushrooming of coaching centres in India.<\/p>\n<h2><span style=\"color: #000000;\"><strong><a id=\"toc3\"><\/a>What was The Need to Regulate Coaching Centres in India?<\/strong><\/span><\/h2>\n<p><strong>1. <a href=\"https:\/\/forumias.com\/blog\/upsc-current-affairs-news\/increasing-cases-of-student-suicide-in-india-reasons-and-way-forward\/#gsc.tab=0\" target=\"_blank\" rel=\"noopener\">Increase in student suicide cases<\/a>&#8211;<\/strong> There has been an exponential rise in cases of student suicides from the competitive exam coaching institutes.<strong><span style=\"color: #333333;\"> For ex- <\/span><\/strong><span style=\"color: #ff0000;\">28 cases of student suicides<\/span> were reported <span style=\"color: #ff0000;\">in 2023 alone<\/span> from Kota- the coaching capital for engg. and medical exams.<\/p>\n<p><strong>2. Exorbitant fees and lack of exit options-<\/strong> The coachings charge exorbitant fees and do not provide exit options with return of balance fees to students due to lack of regulatory guidelines.<\/p>\n<p><strong>3. False and Misleading Claims-<\/strong> The coaching centres have been indulging in false and misleading claims <span style=\"color: #ff0000;\">related to selection ratio<\/span> from their institutes. <strong>For ex-<\/strong> <a href=\"https:\/\/forumias.com\/blog\/misleading-advertisements-by-coaching-institutes-the-learning-curve\/#gsc.tab=0\" target=\"_blank\" rel=\"noopener\">Recent fines imposed on UPSC coaching centres for making false claims<\/a>.<\/p>\n<p><strong>4. Engineer or Doctor producing factories- <\/strong>The coaching centres function like a factory to produce candidates well equippied with practice and conceptual clarity to solve the JEE and NEET questions, but they lack heavily in extracurricular activities and life skills. <strong>For ex-<\/strong> <span style=\"color: #ff0000;\">Kota is termed as KOTA FACTORY<\/span>.<\/p>\n<p><strong>5. Absence of regulatory oversight-<\/strong> There were no penal provisions and there was complete lack of regulatory oversight. <strong>For ex-<\/strong> <span style=\"color: #ff0000;\">Inapplicability of Consumer Protection Act for the coaching industry<\/span>.<\/p>\n<h2><strong><span style=\"color: #000000;\"><a id=\"toc4\"><\/a>What will Be The Advantages of New Guidelines for coaching centres?<\/span><\/strong><\/h2>\n<p><strong>1. Stem the rise of Student suicides-<\/strong> The proposed guideline is a step to address this stem of student suicides by providing <span style=\"color: #333333;\">mandatory provisions<\/span> for <span style=\"color: #ff0000;\">customised leaves<\/span>, <span style=\"color: #ff0000;\">mental health counselling<\/span> and <span style=\"color: #ff0000;\">emotional boosting<\/span>.<\/p>\n<p><strong>2. Regulation of unchecked growth of private coaching centres-<\/strong> The proposed guideline is a step forward to regulate the unchecked growth of private coaching centres which have been<span style=\"color: #ff0000;\"> indulging in malpractices<\/span> like <span style=\"color: #ff0000;\">misleading claims<\/span> and <span style=\"color: #ff0000;\">false advertisements<\/span>.<\/p>\n<p><strong>3. Transparency in functioning-\u00a0<\/strong>The move will introduce in an element of transparency in the opaque way of functioning of these coaching institutes. <strong>For ex-<\/strong> <span style=\"color: #ff0000;\">Creation of a website mentioning all the details about the coaching institute.<\/span><\/p>\n<p><strong>4. Provide an exit route-<\/strong> The guidelines provide for an exit route for students in case they want to drop out, with provision of return of fees. This will help to <span style=\"color: #ff0000;\">reduce the undue stress of students<\/span> to continue a course which they want to drop out of, due to fear of loosing money.<\/p>\n<p><strong>5. Holistic well-being of the student-<\/strong> The move will help in the holistic development of students in a coaching, both <span style=\"color: #ff0000;\">academically and in co-extracurricular activities<\/span>. This will help us in better reaping of our demographic dividend.<\/p>\n<h2><strong><span style=\"color: #000000;\"><a id=\"toc5\"><\/a>What Should be the Way Forward?<\/span><\/strong><\/h2>\n<p><strong>1. Proper Regulation by the state government-<\/strong> Since most of the engineering and medical coachings take place at the 10+2 level, state governments have been entrusted with the regulatory function. State governments must diligently ensure the regulation of coaching industry.<\/p>\n<p><strong>2. Public education-<\/strong> There must be a large-scale public education about the adverse impact of putting such pressure on children from an early age <span style=\"color: #ff0000;\">through media<\/span> and <span style=\"color: #ff0000;\">civil society organisations<\/span>.<\/p>\n<p><strong>3. Instilling sensitivity in Parents-<\/strong> We need to make parents sensitive towards their <span style=\"color: #ff0000;\">children in their adolescent years<\/span>, instead of putting the pressure of parental dream on them.<\/p>\n<p><strong>4. Revamp education system-<\/strong> The <span style=\"color: #ff0000;\">rote learning<\/span> and <span style=\"color: #ff0000;\">exam-centric education system<\/span> in India must be revamped with focus on imparting conceptual clarity to the students to stem the mushrooming of private coachings in India.<\/p>\n<p><strong>5.
