Why in the News?<\/h2>\n

India is revising its Merchant Shipping regulations as it seeks to replace the current Merchant Shipping Act, 1958<\/span>. Proposed legal changes are under discussion<\/span> with the Ministry of Ports, Shipping, and Waterways being the nodal ministry.<\/p>\n

What is the purpose of the newly proposed provisions?<\/h2>\n

The new rules aim to incorporate recent international maritime agreements<\/span> that India has joined<\/span>. They will also streamline ship registration for NRIs, overseas citizens of India, and corporations, including limited liability partnerships.<\/p>\n

Additionally, the regulations will allow for electronic vessel registration<\/span> and accept e-documents<\/span> such as log-books and record books.<\/p>\n

Key Provisions:<\/strong><\/p>\n

1.<\/strong> Three tier- dispute resolution mechanism<\/strong>:
\na.<\/strong> The new provisions propose a three-tier dispute resolution system to address conflicts between ship-owners and salvors<\/span>, as well as between seafarers and ship owners<\/span>, masters, or agents. <\/span>
\nb.<\/strong> The resolution mechanism aims to make the shipping master’s decision enforceable<\/span>, rather than having a Magistrate enforce it.<\/p>\n

2<\/strong>. Clear definition of ‘abandoned vessels’ and regulations for ‘unsafe vessels’:<\/strong>
\na.<\/strong> Clear definitions for terms like ‘abandoned vessels<\/span>‘ have been established. The new regulations also address ‘unsafe vessels<\/span>.’
\nb.<\/strong> The Central government will have the authority<\/span> to instruct port authorities and others to take measures regarding abandoned vessels<\/span>.<\/p>\n

3.<\/strong>\u00a0Coverage of New Areas:<\/b>
\na.<\/strong> The new provisions address marine incidents and emergency response<\/span>, aiming to assure ship-owners of statutory safety measures for vessels.
\nb.<\/strong> There are also discussions about implementing strict rules, including prosecution and conviction, to prevent and contain pollution<\/span>. Air pollution caused by ships at sea is also being aimed to be addressed with appropriate actions.<\/p>\n

Note<\/strong>– Merchant shipping involves commercial activities rather than defence or warfare<\/span>.<\/p>\n
