{"id":28242,"date":"2018-10-24T11:27:51","date_gmt":"2018-10-24T05:57:51","guid":{"rendered":"https:\/\/blog.forumias.com\/?p=28242"},"modified":"2018-10-24T11:27:51","modified_gmt":"2018-10-24T05:57:51","slug":"banks-agree-to-resolve-stressed-assets-quickly","status":"publish","type":"post","link":"https:\/\/forumias.com\/blog\/banks-agree-to-resolve-stressed-assets-quickly\/","title":{"rendered":"Banks agree to resolve stressed assets quickly"},"content":{"rendered":"<p><a href=\"https:\/\/www.thehindu.com\/business\/Economy\/banks-agree-to-resolve-stressed-assets-quickly\/article24497728.ece\">Banks agree to resolve stressed assets quickly<\/a><\/p>\n<p><strong>News<\/strong><\/p>\n<ol>\n<li>24 public, private and foreign banks have signed inter-creditor agreements (ICA) to resolve stressed assets.<\/li>\n<\/ol>\n<p><strong>Important facts<\/strong><\/p>\n<p><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" class=\"alignnone wp-image-23400 size-full\" src=\"https:\/\/i0.wp.com\/blog.forumias.com\/wp-content\/uploads\/2018\/07\/what-2.jpg?resize=475%2C429\" alt=\"\" width=\"475\" height=\"429\" srcset=\"https:\/\/i0.wp.com\/forumias.com\/blog\/wp-content\/uploads\/2018\/07\/what-2.jpg?w=475&amp;ssl=1 475w, https:\/\/i0.wp.com\/forumias.com\/blog\/wp-content\/uploads\/2018\/07\/what-2.jpg?resize=150%2C135&amp;ssl=1 150w, https:\/\/i0.wp.com\/forumias.com\/blog\/wp-content\/uploads\/2018\/07\/what-2.jpg?resize=300%2C271&amp;ssl=1 300w\" sizes=\"auto, (max-width: 475px) 100vw, 475px\" \/><\/p>\n<ol start=\"2\">\n<li>The move comes after RBI dismantling of all the existing resolution mechanisms, such as the joint lenders\u2019 forum in its 12 February circular<\/li>\n<li>RBI asked lenders (Banks, NBFC) to start resolution for the assets even if the default was by one day.<\/li>\n<li>It had also mandated that if the resolution plan was not finalised within 180 days, the account had to be referred for bankruptcy proceedings.<\/li>\n<li>About Inter-creditor agreements (ICA)<\/li>\n<\/ol>\n<ul>\n<li>Inter-Creditor Agreement (ICA) was framed under the aegis of the Indian Banks\u2019 Association<\/li>\n<li>It follows the recommendations of the Sunil Mehta Committee on stressed asset resolution<\/li>\n<li>Both Bank and NBFC could be part of ICA<\/li>\n<li>ICA is primarily focused on the \u20b950 crore-\u20b9500 crore and the \u20b9500 crore-\u20b92,000 crore categories<\/li>\n<\/ul>\n<ol start=\"6\">\n<li>Functioning of ICA<\/li>\n<\/ol>\n<ul>\n<li>The ICA is applicable to all corporate borrowers who have availed loans for an amount of \u20b950 crore or more under consortium lending \/ multiple banking arrangements<\/li>\n<li>The lender with the highest exposure to a stressed borrower will be authorised to formulate the resolution plan which will be presented to all lenders for their approval.<\/li>\n<li>The decision making shall be by way of approval of \u2018majority lenders\u2019 (i.e. the lenders with 66% share in the aggregate exposure).<\/li>\n<li>Once a resolution plan is approved by the majority, it shall be binding on all the lenders that are a party to the ICA<\/li>\n<li>Dissenting lenders can either sell their exposure to another lender at a 15% discount or buy the entire exposure of all the banks involved, at a 25% premium<\/li>\n<\/ul>\n<ol start=\"7\">\n<li>One of the major concern with ICA is to achieve consensus among the lending banks on what should have been a common resolution plan which would have benefited the banks<\/li>\n<li>The Mehta committee had estimated \u20b92.1 lakh crore of stressed assets in the \u20b950 crore to \u20b9500 crore category.
